I864 required documents

Hi peeps,

My husband already have a tax refund from 06,07,08 the 09 have not filed yet.. and he has a w2 from 06,07,08,09.. He dont have a transcript that came from IRS. So on monday he is going to call the IRS to request a transcript from 06,07,08 and 09.. But it takes a week to get it.. We made a mistake. we didnt get it earlier..

My question is Can we send the package of AOS now even though we dont have the IRS transcript ,but my husband already have a W2 and tax refund that his company gave , employment cert and pay stub?

do you think that the NVC will send RFE to us bec we dont send a IRS transcript?

Please help us...

If you have the w2 for the past 3 years too you should be fine.

so we don't need to request for an Irs transcript? we just scared that the NVC might snd an RFE. Thanks

Did you keep a copy of the actual tax form (1040, 1040a etc) from those years? I was in the same situation for 2008 tax year and forgot to get a transcript for that year. I just printed out my 1040 for 2008, signed it and sent it in with 06 and 07 transcripts. No RFE!

I personally would wait the 1 week for the transcripts to arrive then mail in the package. If you get an RFE for lack of proper documents, you will lose more than 1 week in the delay for the USCIS to resume your petition once you send in the tax forms.

As one post suggests, a faxed copy is also a solution. I was not aware the IRS did that.

You don't need the transcripts if you have the W2's and 1040's for the taxes filed for 2006,2007, and 2008.

If your husband recieved W2's for 2009 and if he didin't file taxes for 2009, then I think he should file for 2009 taxes and then send the W2 and 1040 for 2009 after you get the refund. This is as far as I'm concerned. When in doubt, call the NVC at 1-603-334-0700.

Yes, you also need job letter and bank letter.

November 16, 2009: Sign-in Failed!!
November 16, 2009: December interviews already scheduled. Operator told me to wait for a possible January interview date. Call back in the 2nd week of December
November 30, 2009: Been trying to call NVC but line busy since late after noon. Finally, got email appointment letter from NVC with the Interview date of January 19, 2010. Yeppe Alhamdulillah>
December 24, 2009: Medical Done and report recieved the same day.
January 11, 2010: Medical submitted at VFS. They asked for: Copy of Packet 3, Appointment letter, and Passport. They told her to take a copy of I-864 and the documents submitted with it, at the time of interview with other proof of relationship documents.
January 19, 2010: VISA APPROVED!!!!!!!!!!!!!!
January 21, 2010: Visa recieved in mail (Package included passport with visa stamped, sealed big brown envelop to be submitted at POE immigration at the airport, and instructions to apply for SS Card)

USA
February 07, 2010: POE Chicago --> Very easy, within 45 minutes
March 02, 2010: SS Card recieved in mail. Welcome letter recieved in mail as well
March 13, 2010: GC Recieved in mail

January 29, 2015: N-400 Application submitted

Guys I need your input on this:

I'm an LPR and my wife has an interview date next month(in her home country).I have been unemployed for 2 years now but I have already sent in my I-864 and file is now at the consulate.

Neither the NVC nor the consulate have so far asked for a Co-Sponsor.I assume they will but so far they have not.

Just in case I have the Co-Sponsor's I-864 ready with me and I have sent it to my wife,in case they ask for it.

I am wondering why they have not asked for Co-Sponsor yet.

Any input on that,guys?

Search for some additional info on your consulate. Some consulates will not accept co-spnosors. Mostly for K-1s, but you are filing for IR-1, so I'm not really sure. I would call the Consulate and ask the question. I would think that the interview is a bit late to be dealing with it. Makes you wonder how it made it thru NVC....

When the case was still with the NVC,all they asked me was a new I-864 with the signature as I missed signing up the I-864 but they said,bring it at the time of interview.I specifically asked them if they need anything else other than that, they said no.

The consulate too has not raised the Co-Sponsor issue and the interview is 3 weeks from now.What is making me wonder is,if the case requires a Co-Sponsor,they have to ask us to provide that well before the interview.Why would they send her home on the interview day since arranging a Co-Sponsor takes time.

BTW my case is F2A not IR,does that make any difference,I don't think so.
