k1 denied jan 5th,just got email from uscis

I got an email today from uscis saying our approved or reaffirmed fiance petition was sent to DOS on feb 19 for visa processing. What does this mean??

It sounds fast but if it is re-affirmed already sounds like great news ... I would suggest to call the DOS on tomorrow to see if indeed they have your petition again.

Visa Processing? It sounds like he was approved?! That's confusing... let me know when you figure it out!! Would be nice to know before you go and get married!!!!

I hate to be a downer, but I have never heard of it happening this fast....EVER. So I have a couple of questions. Did you receive a notice from the service center that they had received it back from the consulate? Did you call them asking the status on your case? The reason I ask is because once they have done the first approval that will be their response up until they have actually received it back and entered it into their computer system. So if you ask them for a status update before it is received back then their response will be that it is approved. I really hope I am wrong however.

But did it actually say it was reaffirmed? Because that wording would not be used for the initial approval. I am certainly hoping it did. And this gives credence to my opinion that you should always wait until you know if they decide to expire the petition before you get married. If this is indeed a reaffirmation, and you had gotten married, you would have no choice but to wait through the process again because marriage would void the petition.

I called DOS over a week ago, and they said NVC had recieved it the day before. I had not even started calling USCIS because I thought it would be at NVC for a month. Then I get this email today. It does say "approved or reaffirmed case". I will call DOS tomorrow to find out for sure.

Also, I know what you mean about case status. I did call USCIS before I knew it was even at the NVC, and it said it was approved back in October. I wasn't even checking the USCIS website anymore, because I know I would be getting letters about our case further. I just got this email today. Then I went to USCIS website to see, and it says same thing, case was sent back to DOS on feb 19, 2010....

Also, was leaving for Morocco this sunday to get married, OBVIOIUSLY we will not get married if this really did get sent back to casa. We will use the 3 weeks as a vacation!! The man who interviewed him was nasty, but did say that if the petition gets reapproved and is sent back to casa, they will give him a visa with no question. I thougth he was full of baloney, now I'm not sure!

That's great news. Will your fiance have to go through another interview? Is there a timeline? Do you know how long this process will take? Congratulations. Maybe complaints about Casa are sinking in...
