One Year & One day difference from marriage and GC, now what?

Dear friends,

my wife entered US on a K1 visa. We got married, did the AOS and after one year and one day she received the GC.

So these are the qualifying dates:

01-20-2007 marriage

01-21-2008 GC with indication resident since 01-21-2008

The "limbo" of 366 days in between our marriage and my wife GC, what was the status of my wife?

Which date should I consider when counting the 3yrs of residency before applying for the N400?

From what I understand, it's the initial date of the first greencard. I could be wrong, though.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

If it is says on her greencard 1/21/08 it is 3 years from that date minus 90 days. So it sounds like around Dec of this year she could apply.

N-400

10/26/09 Sent application to Lewisville TX.

10/27/09 Rec'd Application signed by B. Conteh

10/29/09 Check cashed

11/02/09 Rec'd NOA date showing 10/29/09

11/09/09 Rec'd letter Bio Appointment

11/17/09 Bio Appointment 8am

11/20/09 Called FBI-Prints were sent back to USCIS same day.

12/03/09 Rec'd email from USCIS that the RFE was a mistake.

12/04/09 Rec'd email from USCIS saying that I have been transferred for an interview.

12/07/09 Rec'd letter for interview on 1/11/10 @11am in Fairfax, VA.

01/11/10 Interview completed. Passed test decision can't be made.

03/02/10 Contacted Senator's office...No reply yet!

03/04/10 Senator office called says can take up to 120 days.

04/12/10 Service request filed.

05/12/10 Contacted Senator's office again.

05/12/10 Told over the phone that I was approved. Believe it when I see it!

06/04/10 Senators office tells me the adjudicator who interviewed me thinks I have a criminal record. Send out all paper work showing no criminal record.

06/08/10 Leave for Canada

06/09/10 Get RCMP certificate showing no criminal record. Fax off to senators office.

06/23/10 Approved for Citizenship

06/24/10 USCIS contacts Senators office

06/28/10 Find out that I have been approved for citizenship and they are just waiting to schedule my oath.

07/12/10 Put in line for oath ceremony....wonder how long that will be!

08/18/10 Called USCIS confirmed they sent oath letter for 09/17/2010 at 9am.

09/17/10 Oath ceremony at 9am..... US Citizen!!!! Applied for passport.

Count 3 years minus 90 days from the date that is written on her GC and you'll find the exact date when she will be eligible to submit the N400.

They don't care when you got married, only when they adjusted your status to a resident.

N-400 Naturalization Timeline

06/28/11 .. Mailed N-400 package via Priority mail with delivery confirmation

06/30/11 .. Package Delivered to Dallas Lockbox

07/06/11 .. Received e-mail notification of application acceptance

07/06/11 .. Check cashed

07/08/11 .. Received NOA letter

07/29/11 .. Received text/e-mail for biometrics notice

08/03/11 .. Received Biometrics letter - scheduled for 8/24/11

08/04/11 .. Walk-in finger prints done.

08/08/11 .. Received text/e-mail: Placed in line for interview scheduling

09/12/11 .. Received Yellow letter dated 9/7/11

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

10/20/11 .. Received text/email: Oath scheduled

10/22/11 .. Received OATH letter

11/09/11 .. Oath ceremony

Go from the date on the P.R Card....count 3 yrs from then....you can apply 90 days before the 3 yrs..

Have to meet both marriage and green card dates.

01-20-2007 marriage

Since you have been married for three years, you meet that date right now.

01-21-2008 GC with indication resident since 01-21-2008

But you won't meet the green date until 01/21/2011. But like the others said, you can send your application no more than 90 days before 01/21/2011. That may get your interview done earlier, but you cannot become a USC before 01/21/2011.

What you can do now is collect evidence.
