Opinions regarding leaving job

Timeline

Hi everyone,

Just to give you a bit of background, as you can see from my timeline we have filed for K-1 and got out NOA1 on the 19th of November. I am currently working a job with a 3 month notice period. When would people think would be the best time to hand in notice?

1) When we get NOA2

2) When we clear NVC and are sure we are not going to get stuck in AP at this stage

3) When we have the visa in hand (not a great option, due to it being hard being apart anyway!)

What are people's opinions?

Good question. My fiance has a 30-day notice period, and she resigned a week after the NOA2 arrived. Keep in mind that the petition can take up to 4 months after the NOA2 before the visa is issued... :) Most seem to take less than that though. Good luck!

My current plan is to give notice after we clear NVC, which should leave a little overlap, but not so much as to cause undue distress to us both. Just wondered others thoughts.

It depends on your type of case:

If you have a really simple case: no previous marriages, no co-sponsor, no immigration past, good amount of time together etc, do it as soon as you have you have NOA # 2

But the more conservative way is when you have your visa in your hand.

Sept 22, 2010 VISA APPROVED.

THREE MONTH NOTICE PERIOD??!! WOW!!!

Okay. Well. Personally from the time I got NOA2 it was about 2 months.. maybe a little more. Other people though have been "stuck" at the police check stage.. so yeah..

I think the best would be option 2. Worse case scenario if you get a fast moving case the visa is valid for 6 months so you don't need to worry about it expiring. It will also mean you have plenty of time to book the flight without being charged a crazy price.

yeh is a silly notice period, and can possibly be talked out of, however I am working on the assumption that I may just have to stick it out, in order to bring more money with me when I move! (beats being broke)

I wonder if you couldn't have an informal chat with your manager/supervisor or whatever? Explain what's going on and that you aren't going to give official notice (yet), but your timeline isn't under your control, will they work with you on the end date as it approaches?

London frequently sends out the interview notice with a number of weeks to spare. Maybe with the advance notice you could negotiate a real end date for the job with fewer than 3 months notice.

Also, air fare at the last minute can be expensive. You may want to book your tickets a number of weeks out if you're waiting for the visa to be issued then as well.

Of course, I speak from the position of having the visa in June and POE in October...Having control over our own lives does make the wait a little more bearable.

Just out of curiosity (and not meaning to come across as a wise-a**)...

What happens if you fail to provide the proper notice? I read that the OP is bound to give a 90 day notice that he/she is resigning.... I understand the ramifications of not providing notice if your intent was to obtain another job in your country, but what is the penalty for failing to provide proper notice?

My fiancee tells me that she needs to give 30 days notice in her job. When I ask her what happens if she fails to give the full 30 days she simply shrugged her shoulders becauise apparently she doesn't know either.

A lot of more senior jobs/ management roles here have 3 month notice periods. It's usually because the recruitment process for upper level jobs is more involved and takes longer. Also consider that the replacement may well need to give the same 3 months' notice.

Depends on the company as to what they do if you don't provide adequate notice.

The risk is often when you get paid. A lot of jobs pay 3 weeks' retrospectively, 1 week in advance. So if you start on January 1st, you get paid February 1st but it's only 3 weeks, since a lot of larger companies close payroll around the 20th, give or take. Then on the 1st of March you get a full months' salary, from 21st January to 21st February and so on. When you leave, you give however many months notice, but get paid up to your last working day (so usually some extra days) unless you have vacation pay owing or took more than you accrued, and then they adjust for over/ under pay.

So the risk is that if you leave before your due notice is up, you don't get paid for some of the time worked and lose any vacation pay owing. Certainly in the UK, some companies will pursue through a small claims court any costs incurred (temp cover/ overtime to fill your role while permanently recruiting and if you owe vacation days paid for that too) but it's not very easy for them to do. If they're aholes about it, they technically can and no response from you will result in an automatic judgement in their favour, which can wreck your UK credit rating. EU regulations say that your credit history can't be carried over outside of the EU but should you ever want/ need to return to the UK, you'd be in a bit of a pickle... Not to mention that a lot of industries can be very incestuous, so if you ever needed to get back into it, you'd have burnt a lot of bridges.

In my case, only 1 month is needed and knowing that London give several weeks notice on interviews, I plan on giving notice once my P3 is logged. They already know that I'm leaving sometime around August but that I can't confirm my leave date until we're much further along with the process.

With 3 month's notice, I'd probably give notice when the NVC confirms they've forwarded your case to the embassy. London is taking a long time to log P3s at the moment and seem to only be offering interviews for those they have logged once a month, with those dates ranging from 2 - 4 weeks. So if it takes them 4 weeks to log it, 4 weeks to assign the interview date and 4 weeks to interview, you'll be pushing 12 weeks from them receiving your case file from the NVC (assuming you find out when London received your file).

But yeah, definitely talk to your boss and explain that the earliest you'll be leaving is x date (working on current timelines) and how much flexibility is there for overlap between your replacement joining and you leaving, in case it takes longer than you think.

Hi,

That is a long period of time for notice!! But I'm going to go ahead and say you should give notice after you receive your NOA2. We received ours on November 25th and my fiance has his interview on Feb. 18th, and that is also considering it took us a month and a half to receive his birth certificate so we didnt send the package 3 back until 6 or 7 weeks after we had originally gotten it. So, if you're sure you want to leave right after you receive your visa, go ahead and give notice after the NOA2. However, you could potentially be denied the visa and then you'd be out of a job but the likelihood of that happening is very very very low. So I think you're making the right decision.
