Why it seems I-129F is taking so long...

Alright it's only taken me close to 4 months to figure this out...but I think I understand why November filers are being approved while I continue to wait for any word at all...even a touch...

Here is my theory...which is probably obvious to everyone else here, but I only realized during an epiphany I had earlier in the day...

While browsing Igor's list, and being generally sulky, I made an interesting observation.

I noticed how everyone who has already been approved sent in their I-130's a month or so before I did. Right now, I-129F's that have been approved, generally had their I-130's sent to CSC in September or before...

I, however, sent my I-130 in October.

And I got to thinking...I-130's have to be approved within 5 months of being received in order for USCIS to avoid calls from Senator's offices and a myriad of infopass appointments...even if an I-129F was sent a month later...

So...if the I-130 is sitting at 4 months, 3 weeks...but the I-129F is sitting at 3 months...they've got to get moving on that I-130. To me, it looks like the I-129F was finished in record time, while I continue to wait...but in reality...they've only got a week to get that I-130 finished in order to stay within their 5 month timeframe.

Does that make sense? When I was browsing members timelines today, it hit me...that's the reason why I'm not approved yet...and, probably won't be approved for another week to ten days...

Any thoughts?

Recalculate your math. Your I-130 NOA1 was issued on 10/15/2009, so 4 months would be 02/15/2009. You have 5 more weeks to reach the 5 months timeline.

I and others have not been able to understand the approval process at CSC or VSC. I don't think CSC or VSC have a clue and probably don't care as long as the petition is approved within 5 months.

My math isn't based on it being approved at 5 months exactly, as most petitions are approved before the 5 month mark.

And it does make sense, when you think about the fact that CSC's own estimation time line gives 5 months for the processing of the I-130, even even if they received the I-129F last week...in order to stay within that 5 month time line they're going to have to get that I-130 through.

Oh, and my NOA1 has a received date of October 2nd...the USCIS website says that the petition was received on October 15th...I didn't know which to go with...so I opted for the latter to be on the safe side...

that sounds like a good theory, and that could be possible... I have no idea why some ppl get approved and others do not. I think it has alot to do with the organization and the materials included in the I-130 packet... obviously the more evidence you include.. with all the required documents the more dry cut your case would be... meaning... the lazy americans <yea I am one of them> would approve the easier applications first... and then go back to the ones that they would have to think about, or get some more information on..... Just my thoughts on it

Your I-129f timeline starts when it is received, which nulifies the time of your I-130. That is why VJers were sending in the I-130 and I-129f together for the short time the USCIS allowed it.

There was an adjudicater who posted on VJ a few years ago. Each adjuicator has boxes of petitions waiting to get approved. The adjudicators are to approve one petition per hour.

So our hypothesis was some adjudicators may be faster than others.

My I-129F was sent the day after I received my I-130 NOA1 as per the time line in my signature...

I've resigned myself to realizing that the only thing governing the adjudication of my petitions is Chaos Theory...
