you should have no problem depositing it into your account.

If the check says "mr smith AND mrs. smith" then the bank might not allow you to deposit the check if your wife does not sign it & have her name on your account as well. If it says "mr. smith OR mrs. smith" you should be ok.

I think it should be fine to cash the check at the bank and if they dont allow you to then you could go to any convenience store that cashes checks and they definitely wont require both IDs.

I also had a question. My husband will not be here until next week, but I wanted to go ahead and file my taxes before he gets here. He is coming in with his CR-1 Temporary visa but will not receive the social for another 2 or 3 weeks after he gets here. My question is can I go and get him a tax id number without him being present? If I can where do I go or what do I fill out to get him a tax id number?

Thanks for any advice any of you could offer me!!!

Apply for a w-7 individual taxpayer identification number (form available at IRS.gov) if you want to file before your spouse gets here, but my recommendation is to just wait for the SSN card. If your spouse will be here next week on CR-1, and you checked the box on the I-130 appliation for automatic issuance of a SSN card, the card should arrive about 2 weeks after your spouse arrives--at least that's what happened in our case...

Just deposit it at your bank's ATM (no dealing with people...).

If you take it to a person, at some places, because it's a gov't check, they'll require both people present/signature...

Nancy,

Go to irs.gov and download form w-7 for tax id (itin number), but most people did is submit both tax return and w-7 at the same time to irs. w-7 must accompany a photo passport (notarized)

Depending on your bank, you may be out of luck, I signed up for direct deposit of our refund before my wife was here and the bank (US bank) rejected it because her name was not on my account so the IRS sent me a paper check.

Then someone at the bank said I could get it cashed with her signature on the check and a copy of here passport as ID for the signature. When I took it to the bank they still wouldn't accept the check so we had to wait until she got here before I could deposit the check.

Luckily Kathlene got here before the check was six months old or I would have had to request a new check!

Some banks will not accept a direct deposit if both names are not on the check. That is what they did to me, I signed up for direct deposit thinking there would be no problem and US Bank rejected it because of both our names being on the deposit.
