Ok, I was looking at the K3 flowchart and the process of the K3 visa. But, I am having conflicting opinions on what happens after your NOA2

Does K3 applicants follow anything on the LingChe Guide to fly through NVC? Because this is what it says

12. Final Stages of NVC

[edit] a. If you were also approved to apply for a K-3 visa (otherwise skip).

If (again big IF) you had simultaneously petitioned to apply for a K-3 visa (by sending in an I-129f) then you may be able to allow that process to continue in order to get an interview date at the consulate before your case is approved at NVC. This requires luck and timing.

USCIS will send your approved I-129f to NVC.

NVC will "touch" the I-129f long enough to give it a case number and pass it on to the embassy.

The embassy will notify the beneficiary of the next steps, and give them the case number assigned by NVC.

The embassy will tell the beneficiary how and where to setup the medical exam.

The beneficiary can then send in another copy of the DS-230 (just the signed pt.1, no other documents).

The beneficiary can schedule a medical exam.

The beneficiary can request an interview date, far enough in advance that their CR-1/IR-1 Visa case will be completed at NVC.

Once NVC completes the case, the beneficiary should NOT contact the embassy/consulate to request that they change the already scheduled K-3 interview for a CR-1/IR-1.

Instead, contact a supervisor at NVC, and request that your completed package be expeditiously sent to the embassy/consulate. This strategy is not guaranteed, It will vary by embassy.

Technically, if you have a CR-1/IR-1 that's ready, the embassy/consulate can not issue or schedule you for a K-3. They also can not schedule a CR-1/IR-1 interview...only NVC can.

My question is this... do I follow everything on the LingChe guide as if I was a CR1 petitioner, paying fees, mailing forms etc...... or...... once I have my NOA2 and USCIS forwards my case to the NVC then the NVC will send out my I-129f to my consulate, skipping everything that CR-1 petitions have to do, and the embassy will then contact the benificary to set up medical and send packet 4.....?

Please would love to chat with someone that has already gone through the K3 process

Adding to Melody`s question, can we choose to just ignore the NVC process for CR1 if we decide that we r just gonna do a k?? Cause I believe once a person is here on k3 all he or she has to do if adjust status and thereafter remove conditions if it is a 2 yr GC. ( I know u also can apply for EAD ). Paying all the Immigrant visa fee and all that would look like a waste of money at that point of time. I hope I am making some sense. :-)

K3 is dead. Read the thread about the special notice. It's right in this forum. The visa path open to you is CR1, not K3.

Facts are cheap...knowing how to use them is precious...

Hello pushbrk, now the fog is lifting. I have been searching and found out the the k-3 visa is obselet. My visa service agent has lead my down the wrong path.

I see now that i should be going for the CR1 route. Hope that I can switch over.

hello Amit-N-Melody, I have the same problem. My agency has lead me down the wrong path.

I filed I-130 for my wife in the Philippines. It was approved. Then I filed I-129F. It was also approved.

How can I switch over to the CR1 or IR1 visa process.

I am at the point now of sending in my I-864 Affidavit of Support

hello Amit-N-Melody, I have the same problem. My agency has lead me down the wrong path.

Sending the I-864 IS the CR1 process. Just continue down that road. No "switching" is required.

If the k-3 is dead, and sending in a i-129f slows down the i-130 and nobody is any longer recieving a k-3 visa,,, WHAT IS THE POINT IN ALL THIS <<<SEND IN MORE PAPERS AND EARN MORE HOPE IN GETTING YOUR WIFE HOME SOONER???? USCIS WHY?

When the K3/K4 category was first created, it was to offer spouses and dependents of U.S. citizens some relief and be reunited with the U.S. citizen spouse/petitioner using a temporary resident visa.

Fast forward several years later, the timeline between applying for CR1/IR1 and K3/K4 is practically the same. The information and the forum is still up on Department of State and here on VJ since there are still people who underwent the process before February 1, 2010 (when the changes took effect). No doubt the information will be withdrawn/taken down from the site after the last K3/K4 visa application has completed processing.

My daughter and I were one of the last batches of K3/K4 in 2009. We went down this route because we wanted to. We knew about the downsides (one being the exorbitant fees that were to follow for AOS and ROC), but we pursued it anyway...no regrets. We're together and that was our goal.

I can understand your frustration, but on the bright side, once your wife completes the CR1 process she will have a green card...that means one less hoop (AOS process + set of fees) she has to contend with. She will be eligible to work and she will not be hindered by concerns about transitioning to her new life in the United States...like getting a driver's license, getting a social security number, getting health and life insurance, going back to school (and being eligible for financial aid)...and all that good stuff.
