Doing This All Over Again?

Hi Everyone,

I filed the K3 for my husband back in 2007 and we were successful without a hitch, thanks to Visa Journey. Well, I must say after my husband got here, he had a hard time assimilating and finding work and thus that led to us having communication issues and eventually we sepearted. We continued to live life as married, however, we did not live together. His brother died after that he left to go to his funeral and he never came back.

Well, that was 2008. Now, in 2010, we kept in touch, we never divorced and now we have decided to give our marriage another real try (i should add that we were 21, 25 when we got married). BUT, will the USCIS? He left in late 2008. His Conditional Green Card expired last May and he had gone for some time since then.

It was brought to my attention that we'd have to start all over. I'm just unsure which way to go... I did the K# before. Can I do it again?

Please Help!!!!

Do the CR-1. Cheaper and better.

Start over the with I-130, IR-1 petition. Forget the K-3.

You will need to start all over, but the good thing is you know how to fill in all the annoying forms now :) Go for the IR-1 visa (based on being married more than 2 years), it leads to immediate 10 year greencard upon entry.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

And good luck with the embassy. You are probably going to have a whole lot of explaining to do. Starting collecting tons of evidence now.
