Proving Marital Status

I might be worrying too much, but I just want to make sure everything goes smoothly when he goes for his interview.

So, I'm wondering, my fiance has never been married before, but how can he prove that he's single? I know you can prove you're married because you have your mariage license/certificate. But if you're single? Will they go by what his passport says?

My fiance is actually a Paraguayan citizen with Argentine residency, so his papers are all from Paraguay. Almost nothing is computarized in most third world countries such as Paraguay, so you can lie about anything and everything such as marital status. I love Paraguay, but trying to do something legally is almost imposible!

Ok, to make this short, how can he prove that he's single? Do they just go with their gut instincts and trust what the passport says? I'm afraid they'll say someting like "yeah, you're single? Can you prove it?"

I don't think they'll ask for it. There's not a way to prove one's single. There's not like, a certificate that you get for that.

Don't worry. You only have to prove marital status in case you're divorced or a widower/widow.

I only offer advice - not even legal. Just the plain and simple kind.

I don't know about Paraguay but in Colombia they ask you to get a Certificado de Solteria which is a Certificate that states that you are single.

April 25, 2006 - Mailed I-129F to TSC.

May 1, 2006 - CSC received I-129F.

May 5, 2006 - Date of NOA1.

May 11, 2006 - CSC cashed my check

May 12, 2006 - Received NOA1 by snail mail.

June 30, 2006 - Received IMBRA RFE by snail mail.

July 1, 2006 - Sent RFE back to CSC via express mail.

July 3, 2006 - CSC received RFE at 10:17 a.m. and was signed for by J. Arnett.

July 3, 2006 - Received e-mail from CSC advising they sent me the RFE.

(A little late considering I already received it and sent it back.)

July 4, 2006 - Touched.

July 5, 2006 - Touched.

July 6, 2006 - Touched.

July 6, 2006 - Received e-mail from CSC advising they received my response to the RFE.

July 28, 2006 - Touched.

July 28, 2006 - NOA2 via e-mail.

August 3, 2006 - Received NOA2 via snail mail.

August 4, 2006 - NVC received NOA2.

August 7, 2006 - NVC sent NOA2 to embassy in Bogota.

August 9, 2006 - Embassy in Bogota received NOA2.

August 25, 2006 - Jose Carlos finally received Packet 3.

August 28, 2006 - Jose Carlos faxed it back to the Embassy.

Stepember 12, 2006 - Received Packet 4.

September 28, 2006 - Interview 7:00 a.m.

September 29, 2006 - Picked up VISA.

November 12, 2006 - Jose Carlos entered USA.

February 3, 2007 - We got married!!!

February 16, 2007 - Sent AOS Package to INS.

March 20, 2007 - Biometrics Appointment.

I don't know about Paraguay but in Colombia they ask you to get a Certificado de Solteria which is a Certificate that states that you are single.

Interesting, I wonder if they have such a thing in either Argentina or Paraguay. Thanks for the info!

This complication is one reason why K1s who have 'engagement' or 'blessing' ceremonies should not use the photos as evidence of the sincerety of their relationship.

I had never hear of a certificate to prove one's single. I don't think we have those in Brazil.

We received our packet for Paraguay, he went to pick it up at the embassy and they spent a bit of time going over everything he'll need and proof of being single never came up. everything was pretty straight forward, she asked him if he was ever married he said no and she said ok good then you wont need this certificate or that certificate. all in all he just needed his medical (which he had yesterday), pay the fee, fill out like 2 forms and that's it.

May 2nd - Sent I-129F to Vermont

May 13th - NOA1

June 23rd - recieved RFE (IMBRA)

June 24th - Sent back RFE

June 27th - 7 touches

June 30th - touched

July 3rd - touched

July 10th - NOA2 notice via email

July 14th - NOA2 via snail mail

July 14th - petition mailed thru DHL to Asuncion, PY

Week of July 17th - Embassy received my petition

July 24th - beneficiary receives packet 3

July 27th - medical exam

Aug 7th - interview - approved :)

Aug 11th - picked up his visa

Aug 21st - purchased plane ticket!

Aug 30th - reunion day :)

You write up a sworn Statement and have it signed and witnessed by a Notary or an official office there in Your Country, Dept of state or something like that

statement should say who he is where he lives and that he swears he has never been married. Simple, done, get to the Embassy with it !

What about a certified copy of his birth certificate? Did they ask him for that?

i think it depends on the country; i live in El Salvador and here you can get that at the "Alcaldia" since its the place where marriages are inscribed so if they have no record there then it will means he is single, hence will issue the document for him, maybe he can ask at ID place or something, dont know how it works there

According to Phoenix Processing office they will take 5 months to process, lets see if they keep their "promised schedule".. (hahaha yeah right)
