Timeline

As you all of you know we were affected by IMBRA, and are awaiting our approval to be reaffirmed. Well, my fiancee Huong just called me and she just received Packet 4 in the mail with her interview date of August 14. What do we do, not say anything and hope they won't realize it. I just don't know what to do. I have all her evidence here and I want to fly there for her interview. PLEASE HELP!!!!

I-129F Timeline:

03-10-06 - Sent I-129F to USCIS

03-15-06 - NOA1

03-25-06 - NOA2 Approval

08-28-06 - Interview!!!

11-22-06 - Got the Visa!!!

AOS Timeline:

02-08-07 - I-485 sent

02-14-07 - NOA1 (Sent to Missouri)

03-06-07 - Biometrics Appointment

03-07-07 - Transferred to CSC

05-03-07 - Card Production Ordered Email

05-10-07 - Green Card In Hand

Removal of Conditions Timeline:

03-05-09 - I-751 sent

03-09-09 - NOA1 (1 yr Extension)

04-08-09 - Biometrics

07-09-09 - Card Production Ordered Email

07-17-09 - Green Card In Hand

I-130 Filing for Step-Son

11-30-09 - Received at USCIS

12-04-09 - NOA1

03-01-10 - NOA2

03-05-10 - NVC Case # Assigned

03-09-10 - NVC Mailed DS-3032 and AOS Bill

03-12-10 - Emailed DS-3032 to NVC

03-13-10 - Received Email from NVC stating they received DS-3032 (Also received AOS Fee Bill and DS-3032 in the mail)

03-14-10 - Paid Affidavit of Support Fee and IV Bill online

03-16-10 - NVC Website updated to PAID for both fee's

03-17-10 - Petitioner and Agent received emails to further proceed with case

08-05-10 - NVC Case Completed

10-27-10 - Interview PASSED

10-28-10 - Picked up Visa

Wow Mike, I am sorry that you find yourself in this situation.

This is totally just my opinion: I would think that it could really be dangerous if you move forward with the interview. You don't want to risk your visa because they decide you are trying bypass the process. I don't know much about the consulate you are working with. Can you get any useful communication from there?

Wow Mike, I am sorry that you find yourself in this situation.

This is totally just my opinion: I would think that it could really be dangerous if you move forward with the interview. You don't want to risk your visa because they decide you are trying bypass the process. I don't know much about the consulate you are working with. Can you get any useful communication from there?

Call the Embassy immediately and ask for their advice. Document who and when what was

said...plan on attending interview BUT make sure you have documentation that you spoke

to someone about this. Just my opinion

Wow, Mike! Call NVC and explain your situation. I wouldn't risk going to the interview without the second approval. E-mail the consulate when/if you get something from NVC.

I only offer advice - not even legal. Just the plain and simple kind.

I think your I-129F was approved immediately after July 18th based on your timeline without you being notified. The approved packages are sent directly to the embassy. They get they within days. You can call the Embassy because the Visa Center may not know. good luck.

Let's hope it is the second approval sent to the embassy. I agree with the other Vj's don't risk bypassing the system with a mistake, it will only comeback to get you. Also, your demonstration of honesty with the embassy will be very much appreciated. I have to beleive honesty will be rewarded.

Maybe when you talk to the embassy they will let you know that it is the second approval they are scheduling for.

I would contact your congressman's aid for assistance as well and let them know the situation, it will go a long way and you will get a resolution very quickly.

7-08-06 Stopped by Border Securtiy on NCIC name hit - Identity Theft two years ago and theif used my name as an alias which is now permanently tied to his criminal file as an alias - Border Security very helpful and understanding and apologetic about the situation but they have to verify I was not the perpetratpr.

7-10-06 Sent RFE

7-11-06 Received by CSC

7-19-06 Touched e-mail stating received 7-19-06 (BS)

8-03-06 Wondering ####### is taking so long - 128 days now

8-21-06 Congressional Inquiry

It's weird that NVC wouldn't know about it, since they've sent e-mails to other approved recalled petitions, stating that they were being sent to NVC, who would then forward them to the embassies.

It's also weird that Mike would have gotten an approval withou being sent an update e-mail, although I can see that could happen.

I only offer advice - not even legal. Just the plain and simple kind.

Mike, I wouldn´t go to the interview without calling the Consulate before.

However, you should be getting your approval very soon, at anytime actually.

So I would wait until getting the reapproval and then I would call them.

Much better to say: "You sent the packet 4 and we just got reapproved" then saying "You sent the packet 4 but we were recalled".

hey there. we were sent an appointment date for the interview before coming into compliance with IMBRA. when my fiancee showed up for the intervew, they told her it was an error. i would suggest going anyway... see what happens - it wouldn't hurt. but, expect the worst - that being that they realize the error and say they need the re-approval, i.e. more waiting on your part
