Hi Everyone! Long story short. My SO has seen his mom once since he was 10. She "ran-off" as we might put it, later married and is now a LPR-at least for the past 7yrs. Since his adult years, he's had several denials for visitor's visas. We're thinking they possibly flagged his name because of his mother's initial actions. In talking to her about our K-1 plans, she claims that when she filed her "papers" , she also sent in "papers" on my SO's behalf - she could not clarify exactly which papers or when she filed them :huh: She says she never heard anything from Immigration (nor did she follow-up). We're worried about how this may hinder ur process if something is already in the pipeline and we submit our K-1 Application. My SO has never received any correspondence from USCIS or his mother regarding immigration. On a straw of luck, do you think they may have thrown out the case? I really doubt that if she did petiton for him, that her s**t was together enough for it to be approved. He's now 30, so he would have aged out already right?

Hi Mrs.Ernie -- I know a few people who were in the same situation - so, he's not the only one. None of them had problems with the filings questions later came up at the interview, which they all answered truthfully they're all living in the states now.

Thanks sus and lawny,

Do you think his visa denials could have been because of a pending case? You know they always quote some sub section as a reason, but can I safely assume that an open case is something they would mention at an interview? Can we technically file a K-1 if his mom's filing is waiting on a visa# ? Sus, do you have any experience with the FOIA? Can my SO submit one? He literally has no connection to USCIS, no receipt no. or anything and I doubt his mother will be helpful, we asked her to call the customer service line to check on her case and met grave hesitiation. :angry

He can file a FOIA - but I would go with Lawny's post and just go forward - she has seen more of it than I have - A FOIA is simply a request for info under the freedom of information act, which he is entitled to -

The denials are hard to say - because in JA, it doesn't seem that there is a rhyme or reason why people get denied for a visitor's visa - I have seen people who meet all the qualifications get denied, and others who had no money, couldn't prove substantial ties, etc... get through - I wouldn't stress too much over those -

Exactly....

My friend had no information either, his woman filed K-1 last year.... His father had filed for him God knows how many years ago, but never followed through. His dad was an overstay who later married and then filed for him and his siblings, but he never finished the paperwork. They did ask him at the interview if anyone had filed for him, who and how long ago...and what happened, but that was about it. Hell -- they had information on me from the early late 70s...so if they ask, he should answer. If he don't know, HE DON'T KNOW!

:) Thanks Guys, I'm a little less worried now.

Hey after a while papers expires and cases will be closed if immigration does not here from you through mail, ph call or email. That is what happened to my brother's wife. He filed for her and after a year of immigration not hearing from any of them they send a letter a year later stating that there were going to close the case due to the fact that there was no activity on the case in other words no one inquired about the case for at least one year.
