Don't believe my lawyer

We've also been advised to do that by a lawyer... do they all read the same book, or what?

Anyway, I felt way to uncomfortable with the idea, and I have way too much stuff to just "go". Not sure how you can know you are going to live in another country, leave your job, put your things into storage and not have to lie at one point or another during the process. Most of the times I've crossed the border since being with my husband (and before as a tourist), I've been asked what I was doing for a living and when I was planning to return to Canada.

Another point that made me uneasy is the inability to work or get out of the country until the process is done.

Maybe the idea is for people to try that method of entering the US as a visitor knowing that it could result in serious issues. Which then would lead them to having a ban on them or such. This way they now would really need to use more of the lawyers services and pay a lot more money to get that fixed up.

Almost seems that they are doing it for you to get caught, because I just can't see how many lawyers (from what everyone is saying) seems to suggest this idea when it's blatently illegal...

I'm just a wanderer in the desert winds...

You don't need a lawyer to file for any visa to be with your boyfriend. Everything you need to know is on here, just read the Guides to figure what visa is best for the both of you.

I'd most definitely do this the right way by filing and going through the process that's legit but of course that option is up to you. If you do decide to go the legal route I would look into reporting the lawyer's advice. Although I had a great lawyer who told my wife that this illegal option is often given but told us about the legal process which we used, other lawyers give this type of advice without thinking of the consenquences if you're found to be visiting with the intent to marry. Think about it, the lawyer either has a customer that they can charge for almost a year if everything works out, but if it doesn't they're not the ones that could get a lifetime ban.

Choose whichever way you wish but keep it in the back of your mind throughout the entire process that you could get caught and receive a very harsh punishment.

As Kathryn very wisely mentioned: your lawyer doesn't have to deal with whatever consequences result, you do.

There is more than enough information here to support a legal course of action when it comes to moving across the border, and moreover, doing so without the unnecessary expense of a lawyer.

As has been stated already, most cases don't require a lawyer. There have been some VERY unique cases in this forum alone that were dealt with by the couple alone -- no legal assistance.

Furthermore, I'd be tempted to get the lawyer to suggest that to you in writing...then send it to the USCIS or a similar body. Think about it: you're surely not the only person this lawyer is giving misinformation to. How many lives has he already impacted due to his deceptive advice? Even if he doesn't know that he's giving ILLEGAL advice (I can't see how he wouldn't...), he should be taken to task by the appropriate authority so that he doesn't potentially impact more lives in this way.

I'm just curious as to why you keep asking the same question. You obviously have your mind set on that path. If you're looking for us to pat you on the back and tell you everything will be okay, you've come to the wrong place.

Actually exactly what I was thinking. If I could have it my way I'd love if anyone who tried that way got banned instantly for a lifetime

Oh, well that's rather harsh.

It honestly doesn't matter to me one way or another. I don't know their lives. I just get confused when people ask the same question over and over. It's like they're trying to find approval and justification for their actions. VJ is just kind of a weird place to search for it, though. lol

Maybe I've got it all wrong.

Haha I'm just REALLY against people knowingly doing the wrong and illegal thing, especially when it becomes clear they're just looking for that one person to tell them "Don't sweat it, it'll work out."

Definitely funny that on a site which has it plainly posted that it doesn't approve or allow any advice/questions on illegal activity that it still happens so much

If people think that a lawyer has given them bad advice verging on illegal which could have serious consequences (ie: 10 year ban), you can always contact the law society of the province that they operate out of. Let them know your concerns, and the law society will follow up.

The US has similar agencies in each state.
