I am glad you're keeping up the fight. Don't give up!

It might be helpful to go over ALL the questions asked -- I know they seemed to focus on the "How did your parents feel about you marrying an American divorcee with three kids?" -- but like Gary said, sometimes they use ONE question to berate/confuse the aplicant in the hope he slips up and answers something ELSE incorrectly/inconsistently.

i have not read everything that everyone else has asked you or stated.......but did his family write and sign a letter about the engagement showing that they know about it? one thing i would do if u refile is have them address this issue that seemed to catch the attention of the person giving the interview.......delhi is a pain in the butt......they are not a friendly embassy and seem to act on what ever they feel is correct regardless of humiliation and pain they give the person in the interview....

i have written to Mrs Clinton a few times she i believed helped us get out of csc black hole but at this point has not bothered to respond to any letters i have written........she did state when she helped us thru csc to contact her if we had any more problems with this visa.......

Where do I find her fax # or the address to write to? I've looked all over the website, maybe I'm missing it. I did email DOS already. I still want to contact her more directly if possible.

January 2009 - K-1 Denied by the consulate

January 2011 - Moved to India - Yikes!

October 2011 - DCF filing rejected by overzealous employee at the embassy

December 2011 - Tourist visa denied (not surprising)

March 2012 - CR1/IR1 process started

May 1, 2012 - RFE and some of our information was entered into the computer wrong by the CSC

Dehli can be a tricky consulate to get thru...please be warned that you are in for an uphill battle. Even though we had a reaffirmed petition [which is rare] we were asked why we hadn't yet married in a very curious manner...with me present they were not hugely mean or anything.

I would reccommend to anyone going thru Delhi with any red flag - make EVERY attempt to go to the interview with your fiance/e.

They are looking for relationships to fit very tight criteria. One of many trips to the consulate I was able to witness a CR1 applicant get drilled on why she wasn't wearing her bangles even though her marriage was less than a year old, how tradition states bangles should be worn for the first year, etc etc - the interveiwee went on to explain that she worked for a large MNC and that most of the young women wore western dress and that she and her husband had decided that after a few months she could refrain...well the CO went on and on about it - I get wanting to separate the wheat from the chaff and all that but the questioning was loud and harsh enough to make me easily 15 feet away bristle.

I'm sorry about what happened to you and your fiance, ms_jinga_lala.

I had a similar story (except for the yelling) and the CO wanted to send my case back to the USCIS to be revoked and my fiancee and I appealed (we have lawyers too) and got the visa yesterday. There's a topic I made telling the whole thing, right now it's on the first page, so if you want, you can read it and see if it's helpfull. It would take some time (took three and a half months after my interview for then to approve our visa) but there is a chance!

Sorry, lately I hadn't been checking thoroughly on this forum and missed this thread.......................

Our case had also been denied at the New Delhi Consulate last year and have refiled for a K-1 ............needless to say Delhi is a high fraud post but that shouldn't justify any ill-treatment of US citizen's to-be spouse. I was researching and found this news item about Delhi CO...............

Unfortunately, because of some bad elements, everyone else going through that post has to go through this humilation, torture and injustice. If you are trying to pursue this by contacting Secretary Clinton, I would be willing to join you in this fight and I am sure there would be others on this forum who would stand beside us.

You are not alone. My fiance and I are going through something similar with the Mumbai consulate. No yelling at the interview, but my fiance was asked questions be several people, and each time he answered them satisfactorily, they sent in another person to derail him. They eventually gave him a 221 (g) notice, and we are in AP since December 21, 2009. I have contacted my local Congressman, sending letters to my Senators now, and I call the DOS visa office about once a week. It is really awful because I do love my fiance, am not committing any visa fraud (as was suggested during the interview) and I want to be with him....and he loves me too. We are trying really hard not to give up, but it is hard when you try and try and don't hear any news other than AP when you call or ask questions. I would advise the original poster not to give up and keep pressuring the Consulate. They have to make a decision eventually, and if they don't, then you have the right to re-file. I am right there with you. I wish I could go to India right now and straighten this out, but I know I dont have the money to do that....and I am sure you don't either. Hang in there....

I posted this on the South Asia forum as well but thought maybe I could get some additional ideas here. My fiance had his interview on the 28th. He was yelled at by the CO and asked the same question more than 10 times (it was being yelled at him). He provided the same answer each time which is what kept angering the CO. He was being asked "What did your parents say when you told them she was divorced with 3 kids?" At one point another woman came over and her and the CO made fun of my fiance and laughed at him when he tried to answer the question again the same way. The CO yelled at him that his visa was denied and he shut the window. It was horrible.

I have emails typed up for the embassy and 4 U.S. Senators specifically requesting a congressional inquiry into the CO's actions and mistreatment of my fiance. I'm requesting the petition stay there and that they grant me another interview. (Thank you Twisted K for those ideas.) Is there anything else I can or should be doing or saying.
