Hey I was wondering, for the passport style photos that go with the I-129F form, does it matter if the person in the picture is wearing anything on their head such as a scarf, but their ears are showing?

Can hats or religious headgear be worn for the photo?

Unless worn daily for religious reasons, all hats or headgear should be removed for the photo. A signed statement from the applicant must be submitted with the application verifying the item is worn daily for religious reasons. In all cases, no item or attire should cover or otherwise obscure any part of the face.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

So ears definitely have to be visible, and the scarf is only ok if it is religious headgear worn daily.

The lady who did mine just said that my hair couldn't be up and since my hair is long, my ears weren't showing.

Ears are part or your head and not your face. It's 50/50 on ears showing or not. We did photos today and the man didn't pose her that way.

Makes sense. They want your face to be as close to your natural, daily appearance as possible, as long as it's visible. Hair covering ears is fine, because that's a part of the way your face normally looks. A scarf covering your ears is an artificial obscurance of part of your normal face.

Well the pic does have my fiancees ears showing, and she is wearing the scarf for religious reasons, and does so everyday at all times. So do I still need to provide an explanation with her signature because it would be hard to do since I am in the US and she lives overseas.
