I assume rules are different in the U.S. and Canada, but some of the situations are the same, so they have to modify what's necessary for proof based on the siuation, like in the person who's posted above case. I'm the USC and I also have a daughter. I've never been married and my daughters father is not part of her life. Never has been. He lives in the same ciy, but I wouldn't know where to find him. When I applied for her passport I was required to show up at the appointment with him or to obtian a notarized letter from him stating he gave permission for her to obtain a passport, which gives permission for her to leave the country. Well, I wouldn't know how to find him, and even if I could, we aren't exactly on good terms. So in lieu of him being present or signing a statement, I needed to attach and complete a Special Circumstances form. I ended up getting her passport 2 weeks later with no problems. My point is, there aren't any cookie cutter cases when children are involved. I agree there was a lack of information present to provide the best response possible, but I don't think posters should be treated like idiots for giving their opinions that may be based on their experiences.

I certainly wasn't trying to treat anyone like an idiot, there are a lot of different things that come up, some even in my own immigration application - where people would have said noooo, i've never heard of that, (I had to submit my Canadian tax returns - as the U.S. sponsor)

So when I asked soonenough about the circumstances, I was in no way implying that he was an 'idiot' or that you were, just asking for the facts - someone may be in the same situation at some point and this is valuable information.

Where we need to sort the facts from the advice though, is when he states:

As far as Paper work make sure that you have all proof FULL custody saying the children are legally able to move to the US. If you were never married previous bring what is called a CERTIFICATE OF NON MARRIAGE

In most cases people will not have to prove that they have full custody and they will simply be required to bring a letter from the other parent giving their permission. So in most cases the above statement is not going to apply, but it's certainly good information to know, with the back story.

Just to clarify my position, I apologize if it seems I began an argument, as that was in no way my intent. When I made the statement about treating the poster like idiots, I wasn't calling out anyone in particular. It was just the overall feel I got when reading the posts. It was my opinion and I can see that it maybe came across a bit harshly. I ready where many seemed to say there was “no need” to obtain a cert of non-marriage, and didn’t mention the possibility of any instance where this might be necessary, more information provided or not.

I didnt mean to start a small argument about this topic... what i should have said was in MY CASE..(So that it didn't look like I was giving "MIS INFORMATION") they gave me options. and those options were.

1. Parental consent of father reimmigration to us (notorized letter)

2. Evidence of No marriage between parents in manitoba.

3. and some sort of custody letter from the courts saying she had custody half or full with no restrictions on the child moving from the canada to the U.S.

The first 2 options were on the letter that the embassy gave me, the 3rd was what the interviewer told my wife but didnt put it on there because that would take too long and she understood that was more of a hassle than anything.

I didnt mean to make it sound like the OP "NEEDED" to bring any of this. What I meant for it to sound like instead was, if they wanted to, they could get a Cert OF NON marriage if thats the case so that hopfully they arent asked for it later. and if they are asked, they are prepared. she did by the way ask if there were any other papers she might need. So I answered with what they had asked for me to bring, as a suggestion but not as a must need. Everyone on here always says be as prepared as possible, right? well thats one more paper of proof only 25$ and done. If you were never married and can't get a divorce decree.

My wife had the same problem obviously in manitoba, all they asked of her was her to fill out a form and for her to sign a notorized letter basically saying that she had no clue where he was. and that was it. We told the embassy that we had to show proof to even get her passport they said they still wanted the above mentioned information. And we also brought the letter to the interview.

So thanks BV2116 I didn't take it as someone calling me an idiot, but more as someone trying to sound like they know everything, instead of asking for clarification :thumbs: When like they say every case is different we all are here to help in any way possible to prevent any waiting longer then we already have.

No no...it's not Montreal's fault. Honestly. The folks at Montreal are, by almost all accounts, excellent. The problem is quite clearly at a higher level. But it looks like they're back up to speed now!

That is absolutely true, when we think of Montreal, we only think of K-1's or IR/CR-1's. However, this is the only consulate in Canada which processes Immigrant Visas, which includes other family based visas along with the non-immigrant visas. After coming out of those staffing shortages, they seem to be doing a good job.

I am happy for all those IR/CR-1's who got scheduled today. I hope us K-1's hopefully hear something really really soon *Keeping fingers crossed*.
