My finacee k1 was denied last year because the CO thought that our relationship was a sham.our case was sent back and closed..so how do i resolve the first case before we file for our cr-1.some posting here say that u need to resolve the previous case b/4 u file another that way it wont effect ur new filing....need help..thxs

oh if u dont mind what's the reason why it is denied?...

N-400:
May 9, 2017: N-400 packet was sent
May 15, 2017: NOA1 
June 05, 2017: Biometric Done
June 19, 2017: Case is in Line for an Interview
June 25, 2018: USCIS Scheduled an Interview
Aug. 02, 2018: Interview Date- APPROVED!
Aug. 09, 2018: Oath Ceremony

Send a notarized letter stating you are cancelling the K1. Hopefully you know the reasons she was denied and have correct such.

Getting married doesn't necessarily keep you guys from being denied again.

My fiancee was denied because of lack of pictures and I had made only 1 short trip to see her.

Second time a year later with a different [spouse visa] lady I made multiple trips, LOTS more communication records and TONS of captioned pictures.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

they never gave u a reson for denial...but we are suspecting that after home investgation the CO didnt get much of any information ..but we dont really know other than, they say it was a marriage for immgration purposes..uscis sent us a letter after it sent back to them saying that the case has been closed due to time limit ..so how will i send and who and where do i send the notrized letter and we have lots of proofs now ...

If USCIS sent you a letter indicating they have simply expired the petition validity, there is nothing to do about the old case. You start over. Do so by studying the process and what you need to do to establish a bona fide relationship, an actual one plus the evidence to go with it. In many cases, this will require multiple trips and more time together. In addition the effort and commitment required to actually marry will help. Nobody knows your circumstances like the two of you do. Make sure you both have the same level of knowledge to work witih and that you know what is needed to succeed. Then go for it.

Facts are cheap...knowing how to use them is precious...

Thxs all for ur reply especially "pushbrk" u seem very knowledgeable about most of the questions here i read alot of ur responses to peoples questions..we're married now and i just visited her 9mths ago at nigeria,when we had our child and we have lots of pics and letters and cards from friends and family members,but since nigeria is considered a high fraud country what are my chances b/c at our first interview(k1) we also gave them a lot of evidence to surport of relationship but they still put us on AP.do i need an attorney?

forget about the k1 petition, no need to withdraw or anything. uscis has already told you it was dead, so you are free to refile at any time. good luck :star:

Do not send a withdrawal letter on the old K1 , you should read the Marc Ellis article about the effects of doing that. It gets your first petition marked in the system as a fraud finding. What have you done SINCE the first petition that would show more ofa valid relationship ? More visits ??

This will not be over quickly. You will not enjoy this.
