Thanks :)

Well we seem to have everything in order. The only thing of concern is my employment and meeting the I-134 qualifications deal. Im working a seasonal job that has full time positions available, but I havent been offered one yet. So I'm sort of just waiting around to see. I have a job app in somewhere else and waiting on a call back.

So when I'm doing the whole 125% over the poverty line thing, I add me, my daughter and then my fiance correct? And that adds up to being over $18,000 a year? Or am I wrong?

Thanks in advance!

Ok, so I read online where a family of 3 needs to be $22,880, which is the 125% over the poverty lines. With that said, I make no where near that (sadly) so I will have to get a co sponsor.

What do I need to have from them? A I-134 signed and what else? Also, even though I don't make enough, what will I need to submit as well? I have two family members I can ask, but I'd like to know exactly what to tell them I need before I ask them.

Thanks Guys :)

ok the edit button is not working for me for some reason... lol

anyways, i read on the travel.state.gov website that i did not have to be 125% over the poverty line, that was only if the I-864 form is needed. Im so confused now. :( I think I just need someone to explain it in a little more detail for me lol so I can understand completely.

This is what I got off the website:

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

I am sorry ,I am in a similar situation actually and was fishing around for answers.Upon reading your posts,I have a question myself.

When exactly do you need the I-864 also?My fiance just recently lost his job,he was making well above the margin with his previous job and we are now in the NOA2 waiting stage. So incase we get approved faster than he finds a decent job we too would need a co-sponsor .

If you know more about the I-864 it would help me a lot.And good luck for everything, this process makes everyone of us a hero!

This is correct. The main difference between the I 864 and the I 134 is that the I 864 is 'legally binding', meaning you could be sued in court to provide this support if you and your future spouse were ever to divorce. (How often that is done and how successful that is would be another matter, though...!)

However, my impression has been that most consulates apply the 125% guideline to the I 134, although that pretty much contradicts what is said above. So it is best to be able to document that at interview time. I wouldn't risk going with 100% only to get there and find out they would deny you on that basis. Plus, as you'll have to file the I 864 at AOS time, it's better to get that sorted out now with a joint sponsor. Just be sure your sponsor knows exactly what this entails.

The practicalities of 3 people surviving on less than $22k a year would concern me as well, but I'm sure you must have a plan in place to mitigate that.

What all will I need to ask my co sponsor for? Like information wise and do I just have them fill out the I-134 form as well as the one I fill out?
