Not correct! Because...

...since April 2009, a waiver petition can be filed to remove conditions, while petitioner is separated, but not divorced.

However, ROC can not be approved until divorce is complete. MissisFu will be sent RFE asking for divorce decree. No decree = denial. Then she will go in front of Immigration Judge, who will (most likely) extend her status so she could complete her divorce.

If not, MissisFu will be put through removal (perhaps kept in the ICE detention center for a few weeks) and then deported. She would be very lucky if her husband (ex or not) would allow her to take their child with her out of the US of A.

You can not file waiver while still married , you filed w/o him (practically and your case is on hold because it is not fitting in neither situation.)

CR-1 Timeline

March'07 NOA1 date, case transferred to CSC

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.

:crying::crying: DOnt even bother making an infopass appointment. I made one and was told we give you a one year extension because the process can take up to a year. meaning the processing time should be year. My app was received June 5th. So it means I should attempt to get in touch with them till June 5th.
