K1 fiance visa question - PLS HELP!

Hello,

My fiance received her 1st package from the US consulate about a month and half ago, and has been trying to collect all the required documents on the checklist (ie birth certi, photos, etc).

Should we wait to send back the required bio form until we collect all the documents? or send out anyway? It has been almost 2 month since she received the package, and I dont want to drag this too long... (hope there is no expiration date on her approval?!)

not sure what to do here exactly... (panic mode)

If anyone knows please let me know! Much appreciated!

Yes - there is a time limit on the K-1 petition/application - it states that on the NOA 2 you should have received.

If you go past that time and do not extend it (by contacting the embassy), they will consider the case abandoned and close it.

Each embassy is different - so you would need to check with them.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

This Takes Forever because you haven't been collecting these required documents ahead of time. Now you are scrambling at the last minute; even from the country of Unknown (according to your timeline) you could have determined what documents to have by now and have had them in hand.

Good Luck. Contact the Embassy and extend or rescedule your interview.

Wanted to add - some embassies will automatically extend the timeframe (usually for something they need done) - but I would not leave it to chance.

Yes the embassy will normally automatically extend the expiration date on an ACTIVE case such as the interview cannot be scheduled prior to expiration or awaiting review. They do not automatically extend the expiration date on inactive cases such as no response to the paperwork in a timely manner.

I would strongly recommend contacting the embassy and allowing them to know the difficulty you are having with gathering the information and specifically asking for an extension.
