I agree.

There is nothing wrong with adoption and certainly nothing wrong with a woman who has children. The very idea that she might be 'damaged goods' is ... well... antiquated at best....

Well put!!

and to answer the OP's question:

Children Have Derivative Status

The child of a fiancé(e) may receive a derivative K-2 visa from his/her parent’s fiancé(e) petition. You, the American citizen petitioner, must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is longer than one year from the date of visa issuance, a separate immigrant visa petition is required.

Remember that in immigration law a child must be unmarried. The stepparent/stepchild relationship must be created before the child reaches the age of 18.

Straight from the Dept. of State webpage, see here:

http://travel.state.gov/visa/immigrants/ty...types_2994.html

As long as the child is traveling with your fiance (or within one year's time), only one I-129F form is required, as long as the child is named on the petition.

As a side-note:

This isn't mean as an insult, but consider having a translator help you with your forms, your english is a bit broken and I'd hate to see you get an RFE for something mis-phrased.

So if i marry her an petition her is her child include? What are the step for petitioning her. Wher planning to get marry this dec. An i am going to petition her.. Thank you.

No, you will have to file an I-130 petition for each of them, her as spouse and the child as step-child.

Once it gets to NVC you will only pay one AOS (Affidavit Of Support) Fee but will provide an AOS Packet for each. Your {future} wife will be applying for a CR-1 Visa and the child a CR-2 Visa.

BTW, the Universe smiles on those who realize that we are all imperfect people and genetics don't make a loving family. My little guy has only known me for half of his short life but I couldn't love him more than I do.

:)

Definitely blood doesn't make one more a 'family' than not.

Good luck to the OP.
