Hello everyone,

My fiance is 17 years old and I am 25. I am trying to get a fiance visa for her. Does the fact that she is under 18 make this process more complicated? I will be able to get both of her parents written permission that it is acceptable for her to marry me. What kind of documents are needed for this? Any help will be appreciated. I have not started the process yet and will get started soon but need help on this matter. Please advice

She has to be legally able to marry when the petition is filed. See your state laws as well as any regulations in her home country regarding the requirements.

Yes I live in NY and she lives in India. Both countries' laws state that it is permissible for a someone under 18 years of age to marry as long as there is written permission by the parents. Please correct me if I am wrong here. I guess aside from notarized statement by both of her parents that they give her the permission to marry, are there any other documents needed.

Uh, unless I'm mistaken -- and I'm fairly certain I'm not -- in India, LEGALLY, the marriage age for girls is fixed at 18. For boys, 21.

Yes, in practice, things work otherwise.

When does your fiancee turn 18? She might be 18 by the time her interview rolls around if you haven't filed for her yet.

YOU need to provide the documentation to prove that BOTH parties are legally free to marry where you will get married. I would attach a copy of the state law where you will get married which specifically allows 17 year olds to get married, or whatever permission is required. If parental permission is required, either here, or for her to leave her country, then you need to attach that also. There is no specific age requirement, it is your responsibility to show you meet all the requirements to marry.

It does not matter if she will be 18 by the time the visa is issued, they go by her age on the day the petition is sent.

For a fiancee visa, the legal age to marry in India does not matter. They will be married in the USA. What matters is the law in the state where they will marry. They must qualify to get married when the peition is filed. You cannot file a petition ahead of time and think..."she will be 18 by that time". If the OP cannot prove they are both free to marry then you have to wait until her 18th birthday to file the petition

I know the legal marriage age in India is irrelevant for a fiancee visa but I'm just putting this out as a FYI. Think of it as a public service to future VJ readers who might contemplate marriage in India.

I did not know about "freezing the date" on the petition.
