Still no word on our case yet, even the consulate "Info Team" has stopped emailing me, that last correspondence I received from them was January 31. I've sent them 3 since then and no replies as of today except the auto-reply which I find odd. Have I used my allotted communication via email with them? Anyone else experience this?

Calling the DOS once a week nets me the familiar "Case is still pending sir". Well I guess its good were still in the Que.

Scott, I would say welcome to the club but somehow I don't think its appropriate. Im pretty sure once you've satisfied their requiements Thuy's visa will be approved. Also, you may want to edit the dates you were put into AP from 09 to 10, same as the others below you.

I'm hoping to post some great news soon.

Do they say Case is still pending or do they say AP? I was told last week, pending review.. and now this week it says AP and there is a notation that my congressman has inquired in the system... He will make another inquiry on the 22nd and then again every 2 weeks or so until they do something... it helps that the congressmans office is a couple blocks from my house and I know the guy that actually sends the email to the consulate. I still need to get my senator doing the same thing in the alternate weeks. that way the senior CO will have to check my case status every week like it or not.

I have to wonder about the email system for us as well... No response to my inquiry from 3/8. I don't expect to hear from them before 3/22... The clerk at the window actually told me I was wrong when I told her that the email system took 2 weeks or more to respond when they respond... not an argument that was worth having with her as she was misinformed about other things as well...

What sup everyone. It's been a long time. It's been since January 7th 2010 when USCIS received our documents. Called them last week and get the same respond from the online inquiry. Already got an attorney (Marc Ellis) to get ready for the rebuttal. We're doing good and talking to each other everyday. Just recently came back from visiting my wife along with my parents. We have lots of good time and very busy since then. Just keep in touch with everyone here on the forum. WISH US LUCK and GOOD LUCK TO EVERYONE IN AP.

I hear both, case still in AP/AR or only case is still pending review. In the early stages of our AP the email response was 7-10 working days. But the holidays rolled in and the responses were a lot slower to come. It’s my opinion that they just got behind.

I honestly think that the HCMC consulate is overwhelmed and understaffed and maybe a bit disorganized. And no matter how much my congressman or yours send inquiries to them, they will get to our cases in the order they were received. We might be better served to lobby for a larger staff which Im sure the Consulate General there is doing every time he gets an email or letter from from a gov official inquiring about a case.

At this point in our journey the only thing that keeps me sane through all this is rationalizing that, One, were in AP for some red flag. Two, there are thousands like me and you in AP and our files slowly inches their way to the top. Three, they WILL get to my case. I had to let go of the anger, I didn’t want it to affect my health. If we don’t have an answer by July Im going back to celebrate our 2 year wedding annv. and make some visits to the consulate. I love and miss my wife so much, Im missing my son learning to swim, going through school and having to watch him grow up on skype, its extremly hard. April 20 is 6 months in AP for us, for my sanity and Duyens, we have to believe that we will have a happy conclusion very soon.

My personal feeling is that is not a good thing, it seems that each time they "clean house" they hand out denials instead of pinks, I would rather see slow movement with pinks every few weeks than tons of denials or more blues, but hopefully if they do "clean house" this time it will be cleaning with pinks not denials

Just got an additional clue that may shed more light on my every 6 month house cleaning theory... The CO's are transfered from one consulate to another, every 6 months... a rotation... If the file is on the desk of a CO that deals with AP, the desk needs to be clean for the next CO.. or at least as clean as can be reasonably done... If I were the one coming into the consulate, I would want to try to get the remaining files out of my way as well... Assuming that they did this in Oct, we should have a new CO at the desk in the next 30 days.

Scott is this fact or just a hunch? Also, Its my feeling that once we were put in AP it left the co's desk to a higher echelon for approval or otherwise. Hell.....who really knows? I like your theory though. Five months and twelve days in AP, I'll take anything positive.

I dont buy into that at all Scott, as when I was just there last week for the marriage papers I saw the same CO that did our interview, I know it was our CO because I remember him when I submitted evidencein October, and he was the CO that did our interview, that is well over 6 months, I know a guy that works at the Australian embassy, and he said he works there for 2 years then gets transfered, not 6 months, that is a DIFFERENT embassy, but the 6 month thing sounds a bit funny, if that were the case they could never get anything done, 1 month for interview from packet 4 being sent, 1 month of waiting for resubmition, then another 90 days of AP that is 5 months there. Just my thoughts, but I think that the CO getting transfered every 6 months is very unrealistic, and improvable. Jerome
