I just mailed the I129F on 12/21/09 and appreciate you all being here for me as I am new to this. My fiance lives in Poland. I met him here while he was visiting his two sisters and their families. Then I accompanied the sisters to Poland to visit him and other family still in Poland. One of the sisters is concerned that the fiance visa will not be issued. She has been discouraged because she applied for her siblings to come here, they waited many years and still no visa so they decided to give up. My fiance was finally given a visa after three denials. We are both law abiding people. I am asking for a little reassurance, not a guarantee--is it likely that a visa will be issued if there have been no crimes committed, or other reasons for a denial?

My second question regards the proof of support for my fiance. I became a full time student at age 51 and have not worked for a couple years. Would that be a reason for denial of the visa? Or is this an issue if he has his own money? He is a co-owner of his business in Poland but also pays support for his two sons. Thanks!

You must have relationship evidence, and a ton of it.

I'm not sure if they will look badly on his past denials for a visa. Sorry I can't help on that part.

His income will not be considered. You have to be able to show that you can support him financially. If you can't, you must get a co-sponsor. Your co-sponsor must be a US Citizen and be able to show support for your fiance + their household size.

Timeline

If your / his liquid assets are equal to 3 times the 2010 poverty guidelines (not issued yet) then a co-sponsor may not be needed. The 2009 income guideline for a 2 person household is 18,212. So the assets would need to be 3 x 18,212 = 54,636. The 2010 may be a bit higher or lower.

Any US citizen or LPR can be a co-sponsor.

His tourist visa denials should not matter unless there were some criminal issues concerned.
