DV Lottery - K1 Visa Forms

Good Morning VJ'ers,

I am trying to help a friend with her and her fiance's K1 visa papers and a question has come up that I dont know how to answer. The beneficiary previously tried for the DV Lottery. He was not selected, however, did submit the application online (in 2007 or 2008).

Does this need to be noted on any of the K1 visa forms and if so where?

She has looked over the forms and myself as well and I dont see a place for it. I thought I remembered reading something that it needs to be disclosed on the forms or there could be issues. :wacko:

Any information would be much appreciated!

It doesn't need to be noted on the K-1 petition.

You are probably remembering the forms you fill out for the embassy - they request previous visa info.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Entering the lottery is not the same as applying for a visa so it does not need to be disclosed. The lottery is only an opportunity if you win to then apply for a visa.

Ok thank you for your replies .... So it is safe to say because the beneficiary was NOT selected for the DV Lottery it does not need to be put anywhere on any forms ? (I129F and the DS156, DS156k or DS157 --- not too sure if all of these even ask about prior visa applications but I want to cover all bases here).

There is no need to put the DV info on any of the forms since the beneficiary has never selected for the DV.

Immigration Process (DCF Japan)

08/06/2008 I-130 petition at Tokyo, Japan

08/13/2008 I-130 approved

| Waited until we were ready to move back

07/13/2009 IV interview at Tokyo, Japan

07/15/2009 IV(IR-1) in hand

Post-DCF

07/29/2009 POE at Las Vegas

08/17/2009 GC(10yrs) received

- naturalization in May 2012 or

- GC replacement in February 2019

My husband was denied 130 visa in Algeria recently. My Congressman asked (when I called for help) if he had applied for any usa visa before (including lottery). They said it could cause a denial because it looks like they are looking for a visa. My husband had never applied before so that was not the case. Just an FYI. You may want to just include a letter with your application that he did enter the lottery years ago but did not get selected. That way they know up front. Better to give them all information than to look suspicious.
