My fiancee, precious, will most likely be having her interview within the next month at the US embassy in manila for her k1 visa. She has one son who will follow under a k2 visa after she arrives here to the US and secures a stable job. We already know that he must receive his visa within one year of the issuance of her k1 visa. Heres my question, for HER interview will she need to bring him with her and will he be needed a passport by the time she has her interview? or will he only need one come the time that we apply for him to follow? Also, hypothetically speaking, how exactly would the K2 process work after she arrives here in dallas, marries me, and secures a job. Is it as simple as sending another affidavit of support for him, applying for his passport, and taking him to his interview (he's only 2 years old)? any advice would be great! thanks and HAPPY HOLIDAYS!

Only have a quick moment to respond, but he cannot apply for a US passport until he's a citizen. Which would be roughly 3 years after he got his green card.

1. she doesn't need to bring her son (children below 7, unless this has changed, need not appear at the USEM)

2. docs for her son will be needed when you apply for him, but better if these are ready to avoid delays

3. the K2 process takes around the average 4-6 months if there are no problems with your application, but if you're plan is to bring the boy when the mother is stable with a job, it won't happen until until she gets her GC, which will depend on how fast you submit her AOS application.

say she gets her visa in January 2010, she arrives here feb or the same month, you marry feb and apply same month for her AOS, and she gets her GC say June (average is 4 months) only then can she apply for a job

but she'll have enough time to find a job before the 12-month limit for K2 is up, hopefully

Hope she can find a job! Not easy these days.

It's way easier and cheaper if the kid comes with her.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
