Documentation for stepchild (K-4) on I-130

How can the documents listed in the instructions for I-130 prove a stepparent/stepchild relationship? Required documents are listed in part 7H of the official government instructions as copies of marriage and divorce certificates. No documents are required that show names of the stepchild's natural parents! This can't be right. Do I need to submit the stepchild's birth certificate or G325A?

okay, I'm trying to remember but when we sent in the kids' petitions, we only had to provide the first page (or at least one page) of the G325 plus passport pics and birth certificates. A relationship is established on the beneficiary's G325 where you fill in what children you have. The 'step' relationship is established by the divorce and marriage certificates.

This is confusing me too. Maybe someone can write a guide on this. What is to be sent with the original I-130 petition.

I know a g325a is not needed?

pics?

birth certificate?

marriage and divorce decree --------- yes

I am so confused with the process for my child too.

Feb. 15/ 07 --- GC approved

Nov. 17/09 -- I-751 sent (Day 1)

reynardine,

Why are you trying to further complicate matters that are complicated enough already. Follow the directions and submit what is asked for.

Note the purpose of an I-130 petition - to show the beneficiary's relationship to you.

reyardine,

You DO NOT send G325a's with the stepchild I-130. You do however need the childs birth certificate and the mothers BC as well as your own, marraige cert. and any applicable divorce/annulment papers. The marraige cert shows the relationship (married to the childs parent) and the BC's show the relationship with parent. The birth certificates show the names of the natural parents and that is required.

Jazzy,

The I-130 does not require the child's birth certificate or the natural parent's birth certificate. I did not provide either with my I-130 for my stepson.

You are correct that it does require a copy of the marriage certificate to the child's natural parent and divorce, annulment, or death certificates ending prior marriages.
