Visa denied in Algeria

My husband went to his interview today and he called me and told me that his visa was denied. They accused him of fraud and did not believe our marriage is valid. They will be sending our application back to uscis. I guess this means we are in ap. He will scan and email the form they gave him when he gets home tomorrow. He went for his medical last week and interview (they had changed the date to the 8th from the 15th). They told him the paperwork was not ready yet and to come back the 15th. He went back today and got the bad news. All these plane flights to Agliers is killing us. I have heard ap can last anywhere from 2 months (not usually that quick but that's what they told him at the embassy) to around 1 year. We have not seen each other in 9 months and this is really killing me (but I know I am not alone). So what happens if the visa is denied? We have to divorce???? I am soooooo devistated!!!!!!!!!!!! My husband thought that because we were married they could not deny us. I told him he was soo wrong and they can do what they want to. I guess he knows now but he does not seem very disturbed by this. Any help, advise, encouragment is greatly appreciated. Thanks so much!!

if they are sending it back to uscis, it is not ap, but indeed a denial. start preparing for a rebuttal.

They told my husband that it would take 1 or 2 months until he gets interview again because they needed more proof from me. Hopefully I will have more information tomorrow.

And for a long wait. Ours took an additional 15 months, and that was considered fast.

I sent an email to the consulate asking them what happened and to please reconsider their decision before sending it to the usa. I will contact my congressman tomorrow once I find out the full story. I don't know if I can go another 15 months of waiting. I am truly devistated.

I'm sorry to hear you are going through this right now. Please get the papeer as soon as possible so you can know exactly what is going on. If it is indeed a denial, please look at the pinned topic in this forum concerning returned petitions. Time will be of the essence.

Algeria isn't usually considered a high-fraud embassy, so it was surprising to me that your husband said he was denied outright. It is possible that they have started to clamp down lately. It's important to think of any red flags you may have had to have caused the consulate to deny the visa, and see if there is any way you can address their concerns. One item in your profile that stuck out to me is that you only met your husband once in person, and you married right away. This could be seen in a negative light by the consulate, and you may need to take another trip to Algeria soon to visit your husband so you can have further evidence of your relationship.

Wait til he faxes you the paper in the morning. You said that they need more information from you. Hopefully the embassy just gave him a 221g requesting more information. Try to breathe until you see the paper tomorrow.

Also, a denial doesn't mean that you have to get a divorce. You'll have an opportunity to overcome the issues.

I can't even imagine thinking of divorce if we didn't get the visa...I would move to my SO's country. I prefer to live here, but if a visa became impossible, I would move.

I wish you the best. Hopefully tomorrow is better news for you.

Sorry to hear about that bit of news. I hope that in the end all will work in both your favour. It is so very sad when you cant be with the one you love... the one you married and hope to spend the rest of your life with. Dont ever give up on your Spouce.

it is something that the USCIS will send you giving you a chance to rebutt the consulate's findings. since you are married, you will have an opportunity to prove your case. we were on a k1 visa application last year, and they did not give us a chance, but just expired our petition. you want to start gathering as much evidence as possible.

TwistedK I am so sorry to hear about your case. So they canceled your application and you had to start all over?? That is horrible!!!

oh thanks. it was last year. now we are at the end of the second filing. prayerfully we will be successful this round. it was denied last year for lack of evidence, so this time around we went into overdrive :)
