Timeline

Sean just crossed the border today so he can come visit for Christmas.

They gave him an I-94.

What does that mean?

EDIT: Paul Mayer said they wouldn't activate the Visa if he didn't bring his packet. He didn't bring his packet. Does this mean they activated his Visa?

I think I found the answer and it is a temporary Visa so they can make sure he doesn't over stay, correct?

The I-94 is basically a tracking thing - let's them know when you came in and when you left - just be sure to have him turn it in when he goes back to Canada :)

Lol Even better, rushing to the courthouse with the two of them in the invisible jet :)

So he took a shuttle to the airport and they stopped the shuttle for about 30 minutes to issue him the I-94.

Then when it was all over, they decided not to give him the I-94 and let him through!

-A small white card stapled to one's passport that states how long one can stay in the USA...

-Cost $6...Issued by the USCIS at border crossings.

-Do not stay past the dates stated on the card, otherwise one will be "illegal" in the country.

Thanks for the info! I looked it up but didn't find all the information you gave. For whatever reason, they never gave him the I-94 but they let him cross. The next time he comes will be to activate his K-1 Visa so I don't think we'll have another I-94 scare!

You're welcome. Glad to be able to help. :)

Lol..the only reason why I know about such....Is because they gave me such when I crossed the border at my POE!

It was issued during my POE, as I said that I wanted to visit my boyfriend (now husband) at the time...

And they wouldn't let me stay for longer than 2 weeks....So my I-94 was issued then, and was stapled in my passport...

Though I stayed longer than that (I know, it was illegal..lol..), got married, Adjuststed Status (and became legal)...

And the rest is history (see my vj timeline for more info)....

I-94s are rare though (especially for Canadians, who are visa-exempt), and are mostly given under circumstances where the immigration officer thinks that one is might be overstaying/staying longer than they should in the USA without status

So if an I-94 is not issued, as a Canadian,your fiance can legally stay up to 6 months...

If an I-94 is issued, they can stay up to the expiry date of the I-94 is issued for.....

By the way, if they do issue an I-94, don't throw that card out when it is expired. Just leave your card in the passport.

They will ask for such when you return back to Canada, and/or during your immigration interviews...(and take it away then).

Yikes! I'm glad they didn't give him the I-94 because he is staying for a month and a 2 week trip would have ruined his return flight! I think it's arbitrary how long they let you stay for.
