We want to marry.. in K1 process now...

Okay for some of you who have seen my other posts on a 'similiar' question, I'm just wanting to say Im not being redundant. Pretty much the deal is we want to marry in March. We dont want to wait until AP hell is over... We just decided we did not want to wait. Upon that... in the instance that we 'did not cancel' our K1... unpon marrying, can we change it to a K3? How can this be done "without canceling anything" and starting the process over? Thanks!!

nope... to ability to transfer.... A K-3 first and foremost requires an I-130 to have previously been filed, then an I-129F petition.... you have no I-130 petition on record... Sorry... your "plan" won't work

This.

You can't change a K1 into a K3. If you marry in March you will have to start the process for a spousal visa from the beginning. This can take a long time to process -usually longer than the K1. You're looking at 6-8 months minimum if not more like 12 months.

Then you would probably have to go through AP anyway - same as you are now.

As the others have noted, you can't change an K-1 to a K-3. You have to start the whole immigration process all over again from the beginning in order to obtain a different visa.

I know you want to get married in March but maybe it will help you decide what to do by asking yourself this question: Is it more important to be married and stay apart longer or stay engaged longer but be together sooner? Waiting is horrible for everyone, but seriously, once you are together the terrible sense of being apart fades away and it doesn't feel so bad anymore. Prolonging that time apart may not be worth the cost to your joy from getting married sooner rather than later.

Personally, I think you should stay the course with the K-1 and not make any plans for a wedding in March unless you have the visa by that time. The decision, however, is yours.
