Affidavit of support for K-1

Hi all,

After much research for the past 3 month this is what I have come up with and please correct me if I am mistake.

My fiance (USC) does not make enough to sponsor me for I-134 for K-1 petition alon. He DOES although make enough annual income when he add child support that he receives for one child. That income is just enough to meet both the 100% for K-1 and 125% for I-485to meet poverty guidelines.

He also pays child support for 2 other children but from my understanding after months of researching, he does not have to deduct the child support that he pays out from his annual income, therefore making enough to meet the income requirements since he also receives child support for 1 child and adds it to his annual income.

The total support would be for 5 people including the petitioner and beneficiary and the 3 children

I want to be on the safe side and make sure that this is correct so that we won't need a joint or co-sponsor.

Any input would be appreciated.

i hope im understanding your question correctly ........for k-1 or any other petition he must claim every person that he supports on that form...not just the people that live in his home but including the children that he supports that do not live in his home......he has to make 125 of the poverty guidelines if he does not then he needs a co-sponsor

You are correct except he does not need the I-134 for the petition. You submit that at the visa application interview, not before.

Child support counts as income when it is supported by a court order, proof of payment and statement of how long it will continue. Child support PAID is NOT deducted from his gross income, HOWEVER the children he pays for count in his family size regardless of where they live or who claims them on their income tax. If he has three children, then yes, your family size count is correct.
