Hi all,

I just need an advice/ help. My husband is a Canadan Citizen has an approved IR1 petition and he's scheduled to have his interview at the American Embassy in Montreal on Jan 21st. I am wondering if he's allowed to travel to the US for a couple of weeks for the holiday? I know he needs proof of ties in Canada, he's currently unemployed. Would the interview appointment enough to prove that he's coming back to Canada?? He's has been coming back and forth to the US before but he has his job then but now I am really confused if it's ok for him to come here in the US now that he doesn't have a job!! please help!! :help:

Sincere thanks,

tenderheart

He could try. The interview appointment is really strong proof that he will return to Canada to attend the visa interview. However, there is still a chance that he may be denied at POE. It's up to you to decide whether you wanna go for it or not.

I agree, the interview is strong proof of the intent to do it "the legal way". In the end though it is all up to the officer at the POE. Good luck.
