Hi All,

Today we hit the 5-month mark for the I-130 I have'nt had a touch since 7/12 and have not heard anything besides that I'm in background investigation? Anything I can do? On 12/7 I will hit the 5-month mark for the k-3 I-129F. I understand that my situation is a little unique where I was "officially divorced" on 4/1/09 (My ex and I were in court for almost 1.5 - 2 years separated) and I married in India on 6/10/09.

I am the petitioner and my wife is the beneficiary.

This is getting to be too much now, any one have any ideas or any advice?

Please keep me in your prayers.

Hi there,

I'm so sorry to hear that you are still waiting. Our I-130 took 5 1/2 months, but was approved after we asked USCIS to investigate, within a couple of days. Are USCIS looking into the delay for you?

Thanks for the input Ruth_a. I did call USCIS today the call center told me to wait another two weeks since they are working on June 15 cases. I don't beleive that...

How did you get USCIS to investigate what did you request for?

The call center stated that CSC is working on cases from June 15, 2009 yesterday, so give it two weeks and call again...

we had exactly the same response on our first call and were told to wait another 2 weeks. We gave them a week and when we called back we explained that this was yet was another call after 5 months waiting and we really would like someone to investigate why it was taking so long. The operator said she would send an official request, with an expected answer within the month.

After this second call we were approved 2 days later. We then also got an email confirming the investigation (although we received this after our approval).

It seems that it really does depend on who you speak to,but I don't think it hurts to call at least weekly until you get an answer or they file an official request.

So sorry you are dealing with this....

Wow! What a bunch of @$$'s!!!!!!!! They asked me to wait and call back next Wednesday, cause the system won't take my service request since I'm not 30 days past the processing time of 5 months!!!!!!!!! ARGH!!!!!
