I-864 Questions

Hello VJers,

As some of you knows, we were approved last weekend. Been completing my documents for the DS-230 package for the whole week and hopefully done until next week. However, my husband cannot start anything with the AOS package papers (don't know if he can start something else). I asked him to call IRS like a month ago or maybe so to get the W2s and tax transcripts for the past 3 years and he received them like few days before he went to Philippines for 3 weeks vacation. After 3 days back to WY, we were approved and checking on his tax transcripts, 2006 is empty and he called IRS why it happened and IRS said he did not file taxes for 2006 as well as 2005. First question is, Will it be a problem if these 2 years were not filed before? According to him, the lady from IRS will send him papers to take care of that then they will send the Tax transcript. Does anyone knows how long will it take?

Timeline

You can get the forms for prior years directly from the IRS website.

It is a good idea to get them filed - keep copies of what he files plus any slips and send those in for the I864.

Additional question, he just got the tax papers in the mail just now! His income for 2007 is less than $18,000. Does it matter? What should we do? 2006 and 2008 income is way higher than 18,000.

No, it doesn't matter. What matters is that 2008 is above the threshold. He should include an employment letter or paystubs showing continuing income.

Thanks Malrothien. You gave us light! Now, the situation is, hubby is having difficulty this year RE: job so sometimes he doesn't have job sometime he does. Does NVC will compute his income for this year? Do you think we need a co-sponsor? Though he was just hired today.

i suggest to get ready a co sponsor or better send co sponsor I-864 packets along with your husband I-864 packets so you won't get any problem or RFE in that case....better say than sorry..

Sept. 9, 2009 - received approval email from USCIS thru CRIS

Sept. 14, 2009 - NOA2 hardcopy received by husband

Sept. 18, 2009 - case number assigned (NVC process starts)

Nov. 4, 2009 - CASE COMPLETE @NVC!

Nov. 13, 2009 - interview date assigned by NVC

DEC. 10, 2009 AT 6:30AM

I agree with Mae, Metro. It would be best in this situation to have a co-sponsor lined up. Good luck! :thumbs:

Guys, does anyone use or had 1040? I was in US for more than a year covering Year 2007 and 2008. Do i need to show Tax papers during the interview?
