ok i moved to the usa from the uk on a visa waiver in april 04 i got married in jul 04 and was all good in dec 04 the marriege went sour. i moved out i had no money to get home etc etc i have been living with friends all over the states for most of the time well about a yr ago i meet a girl who i now live with and she is now pregnant with my child. i am still married to the ex wife but she never sent the paperwork off allthought she had told me she had. so i am wondering what position i am in if any???

1st you would need to get divorced and then you would need to speak to a good immigration lawyer about your options as you have a large overstay on the VWP, which will incure a ban on re-entry for at least 3 years if you left the States.... how have you been supporting yourself??? Working???

It may be posible for you to file for AOS once you are Divorced and them married but you would need to check that out with an immigration lawyer...

If you came into the US on the Visa program and have been living here all this time, you are here illegally. The VWP only allows visitors from participating countries to remain here for 90 days.

You're going to need a good immigration attorney...

HI! First of all ,You should get divorced with your legal wife as soon as you can.

Then ,you should get marry with your current pregnant girlfiend.

Third, you shoul defentely hire a good immigration attorney.

Your case is complicated. Seems that you are in illegal position in U.S right now.

When you got married you even didnt file for the Adjustment of Status procedure and thus you have became a subject to deportation procedure. Also if you had a visa ,i dont know if you got married while your visa was active or after your visa was expired? If you got married after your visa was expired ,that not very good ,but still, you had a chance to file for the Adjustment of Status.

I am thinking that you still have a chance to change your position if you get divorced and marry your new girlfriend,but you Must Hire and Immigration Attorney who is a professional in the complecated cases as yours.

i was told i cant file for divorce cos i am not an american oo and i want divorced i mad ethe biggest mistake of my life getting married to her lol. yes i am looking to hire a lawyer not sure how as no money and well ye lol
