K3 and CR-1 visa advice needed

Timeline

Hello all, I'm Raphael and new on this but have seen how good and cooperating everybody here has been among themselves.

I'm recently received NOA for my I-130 and also NOA for my I-129F. I've been trying to find out what i need to start getting myself prepared for the embassy interview but have been having problems until i found this great site.

Anybody who has knowledge should pls advise me on it. I also heard somebody saying i can file for both CR-1 while the I-129F is been processed. Also anybody who has recently been approved of I-129F been processed in California? Need to have a clue on the timeline.

since your petitions have now been approved by the USCIS... your timeline is no longer dependant on the USCIS (CSC) but totally dependent on the Department of State (NVC & Embassy/Consulate)...

His timeline indicates he got the NOA1, not NOA2, so he's got plenty of time to study the guides and prepare for next steps while in the black hole between receipt and approval of the petitions. He's also go plenty of time to learn to regret having filed the I-129F but that's water under the bridge. :thumbs:

ah yes....

I meant the NOA1 for both of them. I need avice so as to get prepared for the interview. I want more advice on documents, paper works, papers and what i am expected to do and take to the interview.

Why do you say that? I've done the samething & now waiting until my case is assigned a number the NVC. I don't see why 'regret' it. Is there something im missing? :unsure:

Because with filing the I129F, your I130 petition is pulled from it's spot and put at the rear of the line.

Because with filing the I129F, your I130 petition is pulled from it's spot and put at the rear of the line.

Yes, what you are missing is the primary discussion topic in the K3 forum, which is K3 is virtually obsolete. It no longer saves time. It just slows down your CR1 visa, costs hundreds more in government fees from filing to green card and perhaps more fiscally important is that it delays work authorization for your spouse by several months.

but would that even matter if your gonna file AOS. Your spouse would already be in the US with you while this process is going. & thats the whole point, to actually be with your loved one and at that time i wouldnt even care how long its approved, as long as my husband is beside me. i wouldn't be as stressed & impatient waiting until the I130 is approved.

You're not catching on. The K3 route does not get your spouse to the USA earlier. Everything you read that says that is about three years out of date. The procedures changed three years ago yesterday.

Again, this is the number one topic in the K3 forum and has been for quite some time. Do some reading if you want.

So, since both of my husbands I130 & I129f are both approved and are being sent to the NVC, my I129f will just pass there as a pit stop get an assigned number and will go straight to the consulate. However, if i go with the I130, I will still have to receive the first packet, turn things in, wait for response, get the second packet, turn things in, and wait for another response. You don't think that by the time that whole process of the I130 is complete that my I129f would have already been at the consulate and have been scheduled an appointment?

If somebody can afford the extra costs and waiting for work authorization on a K3, then more power to you.

We personally can't. And quite frankly, I don't wish to deal with USCIS more than it is absolutely necessary. I know I will have to in two years, but two years is a long time away.

Logically, the CR1 is a BETTER visa. The K3 will, at the most, save you the 3-4 weeks time at NVC. It's up to you to decide whether it's worth the hassle.

I just wish they'd revoke the K3, and utilize the people working on those visas for the K1/CR1/IR1.

09/29/2009: I-130 NOA1
01/25/2010: I-130 NOA2
03/23/2010: Case completed.
05/12/2010: CR-1 interview at Mumbai, India.
05/20/2010: US Entry, Chicago.
03/01/2012: ROC NOA1.
03/26/2012: Biometrics completed.
12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

12/20/2013: Oath ceremony

They both have their pros and cons. It boils down to time. I rather be with my spouse now and wait over there for EAD rather spend another 3-4 apart.
