What is sufficient proof of a bona fide marriage?

I have read all your threads. It seems like the only thing they need to approve him is the financial support. Yes, the officer did raise some questions, but that is not why you were placed in AR. It seems like they are just waiting on the support documents. Just relax and everything will be fine.

I wasn't worried until I talked to the Consulate Chief, who told me that the Blue Sheet, or I94, SHOULD HAVE ALSO SAID that we need more proof of a bona fide relationship. That's when I got worried, because I have nothing more to give. I've given everything I have! If they are saying this isn't enough, what do I do? I am hoping someone who was in a similar situation has a good idea, something that worked for them. And just to let you know that I am feeling alone, scared, and incredibly worried.

Ok. Let me give you an example if that will give you some confidence, and put your mind at ease.

Alot of times in the initial state of the petition before the NOA2 alot of petitioners are given RFE. Many of these RFE's are more more evidence regarding proof of relationships. Many of these petitioners have already sent them a lot of pictures and so much proof, but still given an RFE for proof of relationship. So, they just submit the same same documents over again, and they get their approval within a weeks time. I know this is not at the consulate stage. But, my suggesstion is submit all the documents you submitted to the consulate, and just a few more that you forgot. If you have boarding passes for your trip that would also be a bonus. What about wedding pictures? Also, if he is an indian citizen. Another idea would be if you can get the petition transferred to India. I am not sure if that would be possible, because he was given a blue slip at the consulate. Not saying that the indian consulates would be less harsher, but since that is his native country it just might be more comfortable for him. I know some people who had initially to have their interview in India, but then decided to have their interview in Dubai. It took some time, but this is possible. I am just throwing out some options that you can consider.

I'm sorry but I disagree strongly with the assertion in bold above. I have seen absolutely zero in the way of requests for evidence of a bona fide relationship coming from USCIS prior to petition approval. This is because in visa cases (as distinct from adjustment of status) USCIS does is not the agency that evaluates bona fides.

USCIS is responsible to determine the petitioner's citizenship, that the couple was free to marry when they married, that they are legally married and that the USC petitioner is not ineligible under the Adam Walsh act. (is not a child molester) All responsibility for evaluating the bona fides of the marital "relationship" falls on the Immigrant Visa Unit at the Consulate abroad.

When a Consular officer requests more evidence of bona fides after the interview, this is not appropriately characterized as an RFE. It is a 221g denial that can be overcome if the additional documentation requested is judged to be sufficient to overcome the initial finding of ineligibility.

Well, let me the one to contradict you. We received and RFE from USCIS PRIOR to getting the NOA2 in which they requested proof of a "Bonafide Marriage". In it it states,

Per section 8 CFR 245.1 © (8) (iii) F: The alien establishes the marriage is bonafide by providing clear and convincing evidence that the marriage was entered into in good faith and in accordance with the laws of the place where the marriage took place, was not entered into for the purpose of procuring the alien's entry as an immigrant, and no fee or other consideration was given (other than to an attorney for assistance in preparationof a lawful petition) for the filing of the petition.

Your statement that USCIS is not the agency that evaluates bona fides is misleading and false. It happened to us and It was approved because we supplied the correct documentation. On a personal note, you seem to be a very negative person. I remember posting a topic on expaditing petitions based on an emergency for a US Citizen. You were negative then, and apparently not much has changed. The person who started this topic is pbviously aprehensive. If you have nothing usefull to add, then stop wasting your time (and ours for that matter).

I'm aware that such requests do happen but they are rare. This is the first I've seen reported in a visa case. They are more common in AOS cases. I'm into truth as needed to help assure success in the process. If correcting untruth is "negative" then so be it.

Facts are cheap...knowing how to use them is precious...

A temporary is likely to raise further questions. I would avoid one of those in this case.

I feel like I'm in a Kafka novel, or the book 1984, or some other crazy place where people have subjective power but no oversight, rules and regulations but no obligation to follow them ... I think it would be better if interviews were conducted by panels, not by individuals. At least then if one member was bias, or in a bad mood, or was inappropriate, there would still be two reasonable, just, and fair members to rule that one out. That's why we have juries and the Supreme Court. Oh well. I'm fantasizing about social justice again ....

Thanks everyone for all of your advice. I will take Kathryn and Starlight's advice and take what I want and need and leave the rest. I learned yesterday that there's no reason to fight with eachother. We're all on the same team. It's all the contradictions and confusion and changing rules and subjective nonsensical decisions on behalf of our immigration system that is causing us to be angry with eachother.

I still say you need to have faith, pray and maybe take a break from VJ until a decision is made. Then you can give us ONE post and tell us how things worked out...

Not to mention, you have members on here having debates about YOUR issues. You really need to give all this a break for awhile...
