The Social Security Administration is a federal department, how can a state law, ie the Pennsylvania requisite that you can't get a SSN without proof that you need one, superced federal laws? You can get a SSN in any state and the regulations are federally standardized. The only restriction that I can think of is regarding replacement cards.

There's some catch with it - You can't apply for a SSN without being able to show eligibility to work. Since he's down here on a K-1, he's not eligible to work. They need something documenting why he would need it, from what I've understood. If I'm wrong, I would *love* to see the link, it would make me breathe a lot easier!

If you are not authorized to work in the U.S., we can issue you a Social Security card only if you need the number for a valid non-work reason. Your card will be marked to show you cannot work and if you do work, we will notify DHS. See page 3, item 5 for more information.

No superceding of federal laws here, we're just following them. The requirement that you need a SS# is a municipal requirement for a marriage license here; the federal law is that you need a valid reason to get a non-work-authorized SS card. They require some sort of documentation that you need it. :)

Did you guys print out the memo avaliable on the forums here?

It explains something along the lines that K-1s are able to work once they get an EAD, etc etc. I took it with me but they never questioned my K-1 visa.

I misunderstood Scooter when he said :

You don't need a reason to get a SSN, just be eligible to get one. I thought he meant that you need to have a specified reason in PA to get a SSN.

Grrr - I hate dealing with health insurers here. Back in October my endocrinologist had my try a new type of glucose monitoring system that I wore permanently and took samples every 5 minutes. I wore the device for a week, then he downloaded all of the information from the device and we were able to get a really good picture of my blood glucose 'history'. I have always been a very brittle diabetic and this information has been very revealing about highs and lows that happen outside of regularly scheduled times for monitoring my glucose levels.

So he submitted the information to the insurance company and they sent back a request to provide them with copies of all of the documentation, all of the graphs and charts, records of every test and every visit I have done for 2009 (I go 4 times a year with testing before each time). So, it amounts to nearly 100 pages but they copy it and send it off to the requested address. A month later I receive a denial of claim notice. I call the insurer and they say the claim was denied because they never received the documentation. So I contact the endocrinologist and confirm that they did indeed send it off and verified the address and everything. I call back the insurer and tell them this. They say they don't have it and can they send it again. Preferably they would like things faxed. So I contact the endocrinologist again, explain the situation to them. They say they will make more copies and send things off again but they can't fax because of the volume of the information requested - it would tie up their fax line far too long and they need it to be available for faxes from the hospital, the testing facilities, etc. So, they made more copies and sent them off. Again, I verified that everything went to the correct address and was to the proper attention of the right department.

So yesterday I get another letter from the insurance company saying the claim is still denied because they still haven't received the requested documentation! What the . . !

So, tomorrow, I get to drive to the Endocrinologists other office (they are only in my area on Tuesdays and I am away this Tuesday), find out from them if they have any more information; see if they will make or let me make copies of all of the information requested again, and this time I am going to go to a courier and personally courier it to the Insurer with tracking confirmation and a signature required so next time they can't pull this bs and say they haven't got it.

Grrrr - as if I didn't have enough on my plate to do tomorrow already. Have I said how I dislike dealing with the US Health Insurance system- they should put me on the payroll considering the amount of hours I spend doing their job.

Kathryn41-Sorry to hear about your sitauation with your health insurance. I hope that you get that sorted out as soon as possible...

Definitely not worth it to have your claim denied because of misplaced paperwork!

Perhaps you can try giving it to the insurer yourself, if they are not too far away, instead of having it couriered and wasting extra costs for that?

I agree, the US healthcare system isn't the best...Wish there could be changes there....

Lol..To this day, I still can never understand the deal with the HMOs and additional paperwork.....

Good grief...People are dying and are sick..And the first question they ask..."What's your insurance?"....boggles me....

Hope you get your "paycheck" soon in having your insurance claim approved soon!

ScooterMac-Lol...There is nothing easy in the entire process, and in life too, sad to say.....

And as I like to say too, "Life is like a challenging immigration journey..."....

Yeah, I know what you mean about SSNs, as they are needed for pretty much everything here in the USA (lol..unlike a Canadian SIN)...

That's odd though, that you would need an SSN for marriage in PA. Surely there must be "exceptions to the rule"? I guess not then in PA....

(lol..I got married here in NYS, without an SSN..or without any legal immigration status for that matter...but that's another story....)

Hope you get your SSN and marriage certificate in time, and congratulations on your upcoming wedding in the new year too!

As I understand it, while you can apply for an EAD strictly on a K-1, it would only be valid for the length of the K-1, and with EAD processing times being two months or more, it's kinda useless (and expensive) to try before you apply for AOS.

The thing is, he doens't have eligibility to work. You can't file for the EAD (unless I've *really* missed something) until after you're married and have filed the AOS paperwork. Right?

When I went to go get my SSN, the girl checked off "eligible to work" and processed it just fine.

You are eligible to work with an EAD card. They don't care if you have the card yet or have filed for AOS yet.
