OP needs assistance with expired K1 filing

Hi everyone, I really need adives...i'm a new member of VJ...After i read a lot of stories in here. I feel very happy that i have someone to talk with and can give me idea...

My fiance went to interview on 2-17-09, and the counslate is unable to issue his a K-1 visa becasue they said his do not fulfill the eligiblity requirements which the consulate has determined, based on his testimony, documents and any other evidence, that we do not have a bona fide relatiohsip. Because of this, the consulate will return his case to the homeland security, CIS for review and possible revocation. It told serval month for CIS to recieve the case.

Finaly i got a letter for the U.S.Department of Homeland Security on 7-10-09 which is NOTICE OF DECSION. It said the petition was approved on 9-20-08 and was forwarded abroad to a U.S. Embassy/Consulate with validity period of four months. Subsequently, his case has been retured to the USCIS with a finding that the beneficiary was not issued the requested K-1 visa. Since the period of validity has now expired i can not be revalidated.

My question is...

Should I go back to China and get marry with him than file a I-130? or

Should i file a new form of I-129F?

What can i do???

Timeline

China is a tough consulate - add to it the 'dead zone time' of waiting for the Consulate to pick up a petition from the bonded warehouse - another 2 to 4 months after it's left NVC.

I guess it depends on the petitioner, yes? He can file another K-1, or go to China, marry, and then file the I-130.

I suggest the I-130 for China - many things are faster NOW than last year with the advent of NVC Electronic Filing.

FWIW, lets wait for that person to finish up the VJ validation process before pouncing on a longish answer? Might be a troll, ya never know.
