Previous marriage information - Relevant ??

May I ask members for some advice on a topic (also faced by another member http://www.visajourney.com/forums/index.ph...&p=3451807) . I'm divorced and have a daughter who lives with my ex. When I submitted the I-129F petition in Sep 2009, I realized that there was no place anywhere in the forms, which asked my about details of divorce (other than just the date) or about kids. I wondered wouldn't USCIS wanna know more about me and my past.

And then I see this message from "Cai xia and Randy R" (http://www.visajourney.com/forums/index.php?showtopic=226039&view=findpost&p=3451807) . So I'm debating should I write a letter to USCIS describing how long I was married, why we got divorced and where is my daughter now...

1) Should I do that now, while my petition is pending?

2) Being proactive - can it harm / delay my case?

3) or should I wait till I get an RFE?

What country is your fiancee from?

Those details aren't relevant to the I-129F. Will be relevant at the consulate level when your fiancee has the interview where they will ask her about your past marriage(s), children, etc. Not because they are fact checking, because they want to measure how well she (fiancee) knows you.

No need to do anything. They don't care about your daughter. That will only come up when you submit the I-134 Affidavit of Support where you would list her if you pay child support. If you don't, then again, she doesn't enter into the immigration equation. And they only want to know you are free to marry, meaning not married.

I just submitted my I-129F and all I could see is that they want to make sure you are legally able to marry - ie single or legally divorced. If you are legally divorced, they want proof. I supplied the 1st 3 pages of my divorce degree which had all the important information (dates, actual decree and judges signature, RJI# etc). I had my brothe-in-law, who is an immigration lawyer eyeball the entire thing to make sure it was complete and he thought that was sufficient.

Formerly of not so sunny Syracuse, New York (and going way back, Davis California!)

- 2008 Aug Met and began online relationship

- 2008 Dec 2-7 Met 1st time in person (England)

- 2009 Mar 28 Became engaged

- 2009 Apr 2-15 Met 2nd time in person (Syracuse-NY-USA)

- 2009 Aug 25 - Sep 25 Met 3rd time in person (Syracuse-NY-USA)

- 2009 Oct 19 Sent I-129F Application to USCIS

- 2009 Oct 30 NOA1 received

- 2010 Jan 20 NOA2 received (Approval Notice)

- 2010 Feb 4 Notified that approved I-129F petition forward to US Emabassy at London

- 2010 Mar 26 - Apr 15 Met 4th time in person (Fairfax-VA-USA)

- 2010 July 29 Fiancee had medical in London

- 2010 July 30 London Embassy Interview Date (K1 Visa approved pending a laundry list of medial stuff)

- 2010 Nov 2 Courier website shows K1 Visa packet enroute for delivery. 1st indication of final approval!

- 2010 Nov 3 K1 Visa packet delivered by courier! Visa's are in the building and in my fiancees hands! (tentative Jan 2011 arrival)

2. How is providing irrelevent unnecessary information "pro-active"? (always hated that non sensical word anyway. The opposite of re-active is pre-active, NOT pro-active which would be the opposite of con-active which is non-existant. "Pro-active" was invented by Yuppies in the mid-80s, I was THERE when they coined the non-sensical term and it was used by people who really had nothing to contribute but non-sensical words which made them sound important to other Yuppies rather than ignorant of the language for some strange reason. The inventors of that word are undoubtedly still in some equally useless meeting somewhere, the problems are worse than they thought and they need more meetings! PROgress is, however the opposite of CONgress)

3. You will not get an RFE for un-needed information

If you ever want to have fun and see Yuppies spit their Latte all over their blackberries, invite me to one of their meetings! :lol:

The only thing you need for the I-129f peition is a divorce certificate and the pertinent dates entered in the pertinet places. USCIS couldn't possibly care less about your previous realtionship. They only care you meet the criteria..."free to marry".
