Waiting for a Visa while pregnant

Timeline

So yay with the joys. I've been out to sea for the last few months because I'm in the Navy. I found out that my fiance was pregnant and thus we submitted her application. She's Russian and I'm American. The package was acccpeted July 15. I know that it was pushing the circumstance and I understand that. Though I was hoping that I might be done with the visa before I returned home from deployment. Returning home in a few days I realize that it won't happend.

OUr child, a boy, is due Jan. 29th and I'm preparing to take vacation in January to be with her for the birth if her Visa is still not ready. Though in this case with my limited time ther. What do I do if my child is born while I am in Russia. What would be the most expedient way to have her and our Child come ot America without messing up the application that is already in. Any suggestions?

Continue with the petition you already have. USCIS will not speed up any petitions based on birth or pregnancy, and if you have already started it I don't think another type of petition will be any faster. You will want to make sure you do a registration of birth abroad for your new son, so that he gets his US passport, he won't need a visa as he will get citizenship based on being your son. Make sure you get the paperwork ready and submit that (I believe to the consulate over there but I'm not positive) as quickly as possible after his birth so that when her petition is ready he will already have his passport ready. Congradulations on the baby!

Wow congrats to both.. Ur wife and I are same expected date of delivery, JANUARY 29th 2010 next yr.. and I am 6 months now. And we are having a baby boy also... And now our papers still at NVC waiting for the case complete.hopefully this week.. just continue ur petitions to her, Like my hubby did.. But we are under cr1.. I think k1 is faster than CR1.. good luck and more babies to come LOL..

July 30, 2013 - USCIS shipped my documents to NVC

Aug 5, 2013 - Arrived at NVC Building

Aug 13, 2013 - Got the NVC case # via PHONE

Aug 14, 2013 - Got the Invoice # via PHONE

Aug 15, 2013 - Send my DS-3032 via Email

Aug 16, 2013 - AOS Pay

Aug 17, 2013 - Got an email to print the COVER SHEET

Aug 21, 2013 - send the AOS overnight at NVC

Aug 28, 2013 - Accept the DS-3032

Aug 30, 2013 - IV BILL pay and Documents Sent to NVC receive the checklist AOS.

The child affects your petition in NO WAY. The petition is for her. Your child will be eligible to be a US citizen and receive a US passport. Your child will not be eligible to receive a visa...he doesn't need one. If the child is born before she leaves, you will need to file a CRBA and get the child a US passport and count the child in your family size on the I-134 for her. If she arrives before the child is born...no issue at all and your family size is 2 instead of 3.

they have expited cases for military personel about to be deployed to combat areas, yes. The petitioner needs to contact USCIS and request a military exoedite if he can show his papers to be deployed. It is about the only reason the USCIS will expedite a K-1 case

Definitely try to expedite! Do a search here on the forums; this way she may be able to get here before the delivery. Congrats!!

ya, I was scratching my heid too - thinking 'military expedite' - contact Navy USCIS Liason office (no, that wasn't an oxymoron, such a thing exists ) . Is special Navy thing - each Service has one.

Good luck with the pregnancy - great news !
