Luz and Robins's GC in hand, Luz's has wrong birth date on it.

Luz and Robin got their GC's today. Luz's card has the wrong birth date on it. The year is wrong. I looked at the USCIS web site and it looks like she needs to file an I-90 to replace her GC. It says the fee is $290 plus $80 for a bio fee. I looked at the I-751 form that we filed and the date is correct on it. Does this mean we must pay an additional $370 to fix a USCIS screw up?

No, you should not pay for it if the mistake is from their part. I remember another thread few weeks ago about the same issue.

I know in the instructions of I-90 it says a fee is waived if there is a mistake, or something like that, and that you need to attach proof of that mistake.In this case, I think you need to send copy of birth certificate, passports, etc that shows the correct birth date).

Try to do a search for I-90 and fee at this forum, you may bump into this other topic. Best of luck, and congratulations for the GC!

As it mentions in the instructions (on the page below), you don't have to pay but include documentation showing it is their mistake.

Your Permanent Resident Card was issued with incorrect information because of a USCIS administrative error.

In both of these instances, you must prepare a Form I-90. On the first page of the application, under Part 2, Application type, Number 2, Reason for Application, check box "b" which reads: "My authorized card was never received," or box "d" which reads "My card was issued with incorrect information because of a USCIS administrative error." Include any documents that support your claim with your application.

For those applicants who check box "b," you must send a copy of your Form I-797, Notice of Action, that you received for your previously filed Form I-485, Form I-751, or Form I-90.

For those applicants who check box "d," you must submit the original Form I-551 card containing the incorrect information that supports the requested correction."

On page 2 of the instruction packet, it says if the card is issued with incorrect information because of USCIS administrative error, you are not require to pay the application base fee or biometrics fee.

Timeline

Gary, make sure when you send the GC and I-90 that you send it signature confirmation. When we received Hachemi's GC after AOS, his name was misspelled. We sent the GC and I-90 to USCIS. They claimed they didnt receive it. We had confirmation that they did. It was the only thing that saved us.
