AP at the NVC

Timeline

After 4 months, my fiance finally got our NOA2 which of course for everyone is exciting and we were thrilled to receive the news. I called the NVC today to find out if they had received our file and was told that they had received it but it had been sent to AP and could not give me a timeframe when our file would be sent to the London Embassy. I then called the Department of State to verify this and it was confirmed. I asked the operator what AP was and was told that this is normal procedure and that the file has to be processed in order to send it to the embassy. I have read nightmare stories here on VJ of people waiting sometimes 6 months before their file is sent to the embassy and that this is not something that happens to everyone. The forums that I have been reading date back to 2007 and 2008 and I wanted to see if anyone else has experienced this recently, or knows any information about what my fiance and I can expect. Is there anything that we can do? Are there more and more files being pulled? Any information that anyone has would be greatly appreciated....

The longest documented cases here on VJ of being stuck in AP for K-1 visas is about 50 days. Just keep calling the NVC every week to find out when your case has actually been sent on.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

The link I posted has a great deal of information that could explain this.. It could be random or it could be a background check flag that caused the file to get pulled. Not much that anyone has found that can be done.. Stephen faxed a letter to the DOS and the next day he was approved, but we dont know if it was a coincidence...

Call everyday during the week after 4 est.. as thats approx. when the files go out...

Thank you for the information. I really appreciate it. Do you have a fax number? What did the letter that you sent say? I feel so defeated at this point. Just getting through USCIS on the front end is enough and I feel like we just started this process all over again. Do you think it would help to contact my Congressman's office? I want to do something but at the same time, I don't want to cause problems either. Do you know if this will cause problems at the embassy or is this just with the DOS/NVS? Thanks again for your help. It is much appreciated.

its actually pretty common and lasts a couple of months at most... the # is in that other topic.. the consulate is DOS as well.. NVC does not cause problems for the consulate..

Hmm, would that make them upset, calling every day? They seemed grumpy when I called them about my case. My petition is also in AP, and there seems a clerical error that has flagged my case to be reviewed by a supervisor. They say my name does not match the name on the petition, yet I have both NOA letters from the USCIS that clearly state my name as the petitioner. The NVC lady said they will flag it and I should call back in 15 business days to get an update. I planned to call in 1 week, i don't want to call too many times and annoy them. I already called twice. The first time I called, I got the case MNL# and found out its in AP but forgot to ask when they received my petition from the USCIS so I called the next day and thats when they told me my name does not match.

Why would they care how often you call? They are paid the same no matter who is on the other end of the phone and the more calls = the more job security they have... I call every day.. sometimes twice in a day... as have many others here... not an issue with the call center... I could see if it was the actual investigator that had to stop what they were doing to answer the phone.... If someone is crabby on the phone when you called, it likely means that someone called and was very unpleasant with them prior to your call... Keep in mind they are just the messenger and have no control over the process... its a call center only... I can think of a few folks here that are on AP @ NVC that could have sent the operator into a tizzy prior to your last call.... This is just a process in the whole scheme of things and if you meet the criteria for to petition for the visa and there are no issues with the beneficiary, they will eventually forward it to the consulate.. waiting sucks but I would rather wait a little longer than allow more terrorists into the country... And when it boils down to it.. that is what the background checks are supposed to prevent...
