When to send I-864?

HUsband missed filing tax for 2007 cos of almost no work so we just sent in the late tax return this week to IRS by post office. We have not filed I-864 yet cos of the back tax we need to file. WE have a co-sponsor. Can we file I-864 to NVC now by

1. using husband's 2006,2007,2008 Tax Returns and co-sponsor's Tax Transcripts for 2006,2007 and 2008.

OR do we need to wait till IRS respond to the late 2007 tax return husband jst mailed in??

Also how long till we hear from IRS??

Personally I would send it in.... If there is an RFE then you can respond to that,,, does not take so long. If there is no RFE,,, then you can obtain additional supporting documentation before the interview at the consulate.
