I-864 questions...

Sorry if I missed anything, I took a look around but was just really confused by all of the information. :)

I'm filling out an I-864 for my husband. We are doing DCF.

I'm still a student so my income will not make the requirement. My Mom agreed to file with me. I'm not sure if she should do the I-864 or the I-864A. I only worked half of the year last year and made around 1,500$. My Mom made around 27,000$. I'm not sure if I count as in her household because I am 21 and I don't live with her. My other sister who is 18 does not live with my Mom and is off at college. I have a young 8 year old sister living at home with my Mom. She is not married. What would her household size be? Me + my Husband + Herself + My two Sisters?

I'm on part 5, I know on (a) is 1 for my husband, (b ) is for myself. (c ) for spouse will be left blank to not double count and (d) is also left blank as we do not have children. for line (e) do I list my two sisters since my Mom is filing with me and they are her dependents? or (g) is where I'm supposed to list my Mom (but we do not have the same principal residence)?

For part 6, (23) it asks for my annual income. I work a campus job at a kiosk. I do have a set number of hours every week, but some days I call off randomly throughout the year for various reasons. How then do I find out my annual income? Do I just go and ask my employer? For (24b) do I list my Mom's income since she is going to file with me (not sure if its I-864 or I-864A yet)?

Sorry for the trouble, I just want to make sure I do everything right. There is so much information so it is very confusing. Thanks! :innocent:

I-864 should be the form. Do you have any tax returns? if yes submit them, if not use your mom as a co-sponsor and have her submit her tax return documents (3 years worth). How many members live in your household.... please do not state anyone twice. Do you live with your mom? if no then only state who you reside with.

Yup, we'll just live at a campus apartment for families. He is not with me now though, he is still in Egypt and I've returned and enrolled back into college to establish my domicile...

You complete an I-864 for yourself using only your earnings/income, including all needed documents (tax transcripts/tax returns, etc) regardless of your income.

Current income - you will submit a letter from your employer stating current earnings/salaryand also submit copies of recent pay stubs. You can project your 2009 income based on that.

Is your principle/legal residence (driver'slicense/tax forms) your mom's home address, or an apartment/house in your college town?

Your household is 2, you and your husband.

Mom's household is her + any persons that she claimed as a dependent on her latest tax return + your husband. Did she claim your 18 y/o sister on her taxes? Did she claim you?

Mom's household = Mom + 8 y/o sister + your husband + anyone else that she claimed as dependent in 08. So her household is at least 3.

If you share the same principle address with mom and/or she claimed you on her 08 taxes then Mom is a household member and would file form I-864A. If neither of those apply then she files form I-864.

My drivers license is a very old address, but I file my taxes under my Mom's address since I change my residence every school year so it is not stable, as I go home during the summer (I usually spend the summers in Egypt, though and don't stay at her house, I just use it to file under for the convenience). So that means I'm part of her household then even though I don't live with her, and she should file the I-864A instead of the I-864? And she should be included under the (g) part 5 portion of my I-864, along with my two sisters who she claimed on her taxes? I'll end with a total household size of 5 then...

I'll ask my employer about the projected income, but it seems hard. Because I work on campus we don't work during the breaks, holidays etc. I also frequently drop shifts when I'm sick and pick up shifts for people randomly as well when I have some extra time. It seems hard to project what my income will be...

You will project what your 09 income will be. The employer letter will give: position held, duration of employment, wage rate, avg # hours per week (if applicable), etc.

Your household is 2 (you and hubby) + 1 for Mom filing the 864A (line 21g) for a total household size of 3 (line 21h). Your sisters do not count toward your household.

Mom's income goes on line 24b of your I-864.

Mom completes the I-864A not the I-864 if you have the same principle residence. Her income is combined with yours on your form I864 (line 24c).

Why do my sisters not count in the household size? My Mom claims them both and their principle residence is the same as ours.

If she claims the 18 year old and the 8 year old, then your moms household size is her + 2 sisters + your husband = 4 minimum necessary income for a household of 4 (2009) is $22,050 so she should be OK, not sure what 2010 levels are

Since you file your own taxes she does not count you unless she claims you as a dependent.

Since 09 is over, you can probably get your 09 income... for 10 you can project it based on your average monthly salary

Be sure that you include proof of family relationship for you and your mother (birth certificate) since she is filing the 864a
