I have no idea. I have never tried to e-mail them. What would you ask them? I ask because maybe you can deal with it over the phone or something.

I only offer advice - not even legal. Just the plain and simple kind.

Does the USCIS reply to all e-mail requests even if they can or not answer the question asked?

I emailed 4x. So far, the only information that was useful was that my file was recieved (3 days before it went on the website) and that original NOA1 dates remained. I have gotten 2 mails saying wait 45 days and earlier this week saying that they would respond/update me in 30days. Update me on what? There were three questions in the email? So, you will get a response, but not one of much use. Only one person responds and they seem to be usually some generic answer. The senators office seems much more efficient.

Depends - I didn't get a response to my first two emails asking specific questions. Third one I got a response that basically said "I know nothing".

Read this for a laugh - this McClellan guy just isn't very high on my list of smart people although at least he isn't mean. But I would have preferred no response than this one

Subject: case status

My I-129F Fiancé Visa petition was filed at the Nebraska Service Center on March 23, 2006. It was transferred to California on June 1, 2006. I received 3 emails and 2 hard copies indicating the transfer. On June 14, 2006 I received 3 more emails indicating the transfer.

I would like to know:

1) How will I receive a Request For Evidence in order to comply with IMBRA? Will this be sent to me via email? Will this be sent to me via US Postal Service?

2) When will the request for evidence be provided to me?

3) When the California Service Center begins to receive returned Request For Evidence information from petitioners, how will you continue to process cases? Are you continuing to use ORIGINAL NOA1 receipts dates or will the transferred petitions go at the bottom of the pile?

I would appreciate any clear and accurate information you can provide.

The petition is at this location and is pending processing, it was received June 1, 2006. Please inquire again in 45 days to allow processing to occur.

Thanks,

McClellan, CAO

I was actually already aware that my petition is at your location and is pending processing since I received 5 emails indicating and confirming the transfer. However, I am still trying to get answers to the 2 questions I asked:

1) When will the request for evidence to comply with IMBRA be provided to me?

2) When the California Service Center begins to receive returned Request For Evidence information from petitioners, how will you continue to process cases? Are you continuing to use ORIGINAL NOA1 receipts dates or will the transferred petitions go at the bottom of the pile?

Sorry, I cannot be more specific. The process should begin next week and you should receive the request for evidence within 30 days. I cannot be more specific as I'm looking at system notes and not actually working in that area. I don't know where your petition is in the process on top in the middle.

Please check back in 45 days if you have not received anything.

Thanks,

That was one of my questions. The response was...this was classic. This response was on june 20th, a week after the USCIS website said they were sending IMBRA RFEs. (I asked what they were asking for or if I could download a form to submit):

"You are correct we maybe required to request additional evidence. We have not yet received what the processing steps will be.

Please allow 45 days for this process to be put in place.

Odds are they'll just say the RFE explains what they need so you'd have to wait till you get it in the mail. It doesn't take too long from the update to the actual RFE at your door. If you didn't use the form with the IMBRA questions, this RFE you're getting's probably an IMBRA related RFE.

Don't worry too much.

Poor McClellan - I think they leave him locked up in a broom closet with a computer and don't tell him anything. I mean really, can he be that stupid? I firmly believe English is not his first language - he couldn't write a simple sentence to save his life.

Well, I used the new form. I know I didn't fill in the military question (thanks to the sample form on www.***removed***) I did my own visa style photo, and it might be due to more evidence for Drinking and Driving convictions. I guess I'll have to wait and see how to respond.

They are all contract employees. He is probably not even at CSC. If I remember right all customer service is done out of an office in New York City. All he is doing is looking at our case information in the computer. I gave up trying emails long ago as only got nonsense back.

Wonder how he got his visa to enter the US? Think it took him almost a year too?

I am sure its just a canned reponse.

I used to work in a tech support job for a phone company. I worked actual hands on suppot but there was people that would recieve email support questions and they had a nice interface that they would click a button that basically replied based on the type of question asked and put there signature to it based on there logged in ID and hit click complete and then it would pop up the next one...I am sure this is probably not much diffrent.

In one day a tech would go through maybe 500 email questions and even when the person got irrate and wanted more then just the canned response they would click the appropriate button and that nice complete button and send it back because thats what there job is and thats the approved responses they are given.

Some customer service groups believe that its all about the quick response but they fail to factor in the quality of such reponse.

So your RFE is in regard to something incorrect or missing in your original petition. I'm not aware of a military question but for the photo it will depend on whether or not your photo complied with the requirements. If not, you will receive an RFE to submit new photos. Either way, I wouldn't waste time on the email (as you can see by the inane responses that are usually received). It will much less painless to wait for the actual enevelope! Good luck.
