i have a very complex immigration question, and if anyone could help with any information it would be greatly appreciated.

My husband and I met in Canada in 2008. He came to the United States in 2008 under the visa waiver program. He was to leave the country Aug 2008. He applied for asylum within those 3 months, and had gotten a letter from USCIS saying that he was allowed to remain in the US until his asylum application was approved or denied. December 10 2008 he was arrested for assault as a misdemeanor. He was taking to Batavia detention facility for almost 6 months. We got married in the facility Feb 2009. I filed an i-130 in May 2009 and then his lawyer said to also file an i-129. I filled that in June 2009. In April he was to appear in front of an immigration judge for his pending asylum case and it was denied. He had the right to appeal, he said no, so they deported him. The visa marriage has almost been 5 months for processing times and they are doing a background check at the moment. Everyone keeps telling me different things that the visa will get denied and then some people have told me it will be approved.

I need some answers if any one can help!!! I need to know if I should be this stressed over this being possibly denied??? Thank you

Your case is pretty complex, my best advice is that you really should consult a lawyer who can help you through this process as you might need the additional counseling above and beyond what can be provided here (other than general guidance and support).... best of luck
