Got NOA2 for I-130 & I-129F

HI THERE EVERYONE. i'M SO BLESSED FOR HAVING THE APPROVAL OF I-130 & I-129F, I DIDN'T EXPECT IT WILL COME SO FAST. SO NOW I AM WONDERING WHAT'S THE NEXT THING TO DO. WHAT FORMS DOES MY HUSBAND NEED FOR HIM TO SIGN AND TO SEND TO ME. ON MY PART, WHAT ARE THE FORMS OR THINGS I NEED TO DO. TO SCHEDULE MY INTERVIEW APPOINTMENT. ALTHOUGH I STILL DONT HAVE THE CASE NUMBER. WILL I GET IT FROM THE PACKET? ARE THEY SENDING IT TO ME RIGHT NOW? OR NEED TO SEND SOME DOCS FOR THEM TO SEND IT TO ME?? SORRY GOT TOO MANY QUESTIONS. Many people on this forum will say drop I-129F and go for I130. I, myself, have got both petitions approved, i'm going down I129f route. Although I130 is considered as the superior visa, I129f category was created in 2002 (i think, could be 2004). The sole intention of the Visa was to reunited spouse's together. With I-129F once the Visa holder arrives in the USA, they will need to get a Social Security Number & EAD (Employment Authorization Document), I think this takes around 4 weeks, hopefully earlier. With I130 you enter the USA with CR-1 (Conditional Residence) visa, you do the AOS (Affidavit of Support) etc. prior to the Interview. Then once you enter the USA with CR-1 you have to years to remove conditions, but you are available to work as soon as you enter. I want to be with my wife ASAP, so I'm going down the I-129F route, hoping it will be fast-tracked!

If you received the approval today then call them on Thursday/Friday. If you go through to their AVR (Automated Voice Recognition); you type in your CIS number, if it was no record found, there's a possibility that the AVR hasn't been updated yet, this is was happened to me. Regarding forms, with I-129F the NVC merely touches it, gives it a Case Number and then forwards it on to the Constitute Embassy, they do everything. They will ask for documents etc. Each embassy defers, some don't even send Packet 3 just Packet 4. You'll need to look at the USA embassy for your country.

Hindocha, the EAD usually takes 3 months- not 4 weeks. It also costs $340 unless you are prepared to file for adjustment of status($1,010) immediately after entering the country. And an affidavit of support is required for both visas. With the K-3 you will actually have to provide 2- the I-134 at the time of interview and the I-864 at the time of adjustment of status.

The K-3 is no longer faster. The I-129f was made available to spouses at a time when I-130s were taking years, rather than months, to approve. When your I-129f and I-130 are approved at the same time, as almost all are these days, there is no benefit to pursuing the K-3. It's not a case of hoping the K-3 will be faster just for you. It won't be.

I know about AOS. You are also correct about the the introduction of I-129f. I did state all this in my post. The only thing I failed to state was the cost of EAD, apologises .

You talked about AOS - the Affidavit of Support. There is the additional part to a K3, the Adjustment of Status, that you must file as well.

Your husband has to prepare an I-134 form and the supporting documents (letter of employment, previous 1044 and previous W2, as well as at least 3 pay stubs). Any other new evidence of proof of bonifide marriage should be sent to you (like airline tickets and boarding passes of recent trips he has made in the Philippines...more pictures since you guys submitted the I-130 and the I-129F...etc) should be sent to you as well.

Have your husband call NVC at least 1 week after you receive your NOA2. The number is (603) 334-0700. Make sure he presses the right number prompts (1 is for Immigrant Visa --- this means CR1 and IR1...he has to press the one that corresponds with the K visa.)

If they don't have your file from USCIS yet, the voice message will say they cannot find it on their system or they do not have it yet. If they do, you will be transferred to a live agent and s/he will give your your case number. You can also ask when they sent or will send your case to the U.S. Embassy Manila.

When you have the NVC Case Number, wait another week to call the Department of State (DOS): (202) 663-1225...press 1 then 0. Ask them if your file has been received by the US Embassy and been processed into their system. If DOS says YES, then you or your petitioner can call the US Embassy call center (the 1-909 number if you are making the call in the Philippines; the 1-888 number if your spouse is calling from the US to get the US$ 18 PIN).

From there you can schedule your interview date. After you are able to schedule the interview date, the agent will ask for your e-mail address and they will send you the appointment letter confirming your interview schedule. US Embassy Manila does not send out Packet 3 anymore. If you don't do some of these things in advance, it may be a while before you receive all the hardcopy letters you need for your medical (NOA2 from USCIS, NVC Letter with your NVC Case Number, US Embassy Notice for Interview Eligibility, and the US Embassy Appointment Letter). When you get all these letters, make as many copies as you can. You never know when you need them...same with your passport.

While you are waiting, you can visit the US Embassy website to download the interview checklist (which is the same link the US Embassy will give you when you receive the letter advising you to make the appointment): http://manila.usembassy.gov/wwwfk3en.pdf

I am planning to secure my NBI Clearance at least 1 week before my interview so that it's current. Most peeps will advise you to have your medical examination at least 1 month before your interview so you guys can address any problems that can possibly come up. Some have opted to go at least 1 to 2 weeks earlier because they're confident that there are no medical issues to be concerned about. You can walk in naman for your medicals at SLMEC, so it's ok. You should at least have in your hands a copy of the NOA2 and the NVC Case Number when you appear at the clinic.

Is your passport in your married name? If not and you wish your passport to reflect your USC spouse's family name, you will need to secure blue and green certificates from SMEF-COW or PRISM by attending a counselling session there. The information can be found on the CFO website: www.cfo.gov.ph

However, if your current passport is still valid and you want to wait till later to change it, that's ok also. Currently passports take 14 days to process, but for an extra Php 250, it can be expedited to 7 days, and an extra Php 99 gets it delivered to your doorstep.

How did you find out when your interview date was? Did you call NVC and they told you over the phone, or, did you have to wait until your constitute received it?

Hi hindocha.

I didn't call the NVC for the interview date.

But by calling NVC to get our case number, then Department of State to find out if our file was received and processed by the US Embassy Manila, I was able to set the date the appointment at the US Embassy at minimal cost.

Everytime you call the US Embassy Manila call center, it costs $ 0.98 / minute if the beneficiary calls the 1-909 number, and the petitioner US$ 18 by calling the 1-888 number.

Calling the Department of State (DOS) spared us from making unnecessary calls, especially if the file hadn't arrived at the Embassy yet. We also stepped up our waiting time because I didn't wait for the Embassy letter instructing me to make the appointment. The moment DOS told us the file was there and was entered into their system, we called the call center and made the appointment because we were eligible for it already.

I don't know what London's process is for scheduling the interview date in your case...different consulates have different protocols...the process as how I described it to stellar8 is how K1 and K3 applicants schedule their appointment at the US Embassy Manila.

The Department of State is the Federal branch that manages the different embassies/consulates.

Your Embassy/Consulate is in London.

What's Department of State, is that your embassy, so my DOS would be London?
