K1 "Original statement"

Hi everyone,

Apologies if I have missed something explaining this, but could someone confirm for me that the "original statement" I need to send to my fiance in America is something along the lines of:

"I intend to Marry X within 90 days of entering America with a K1 visa"

With a signature and date?

That's it! You can get more fancy but that's the basics.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Right here on this site is an excellent "finace intent letter" We used it verbatim, just change the names, dates, etc.

I am currently reading the checklist here:

and looking specifically at the section regarding Affidavit of Support. Now I could have sworn i saw something somewhere about not having to do this any more, or not having to do it for British citizens or something like that? Am I correct in this or have i misread something? (I cant find the original place i read it)

and looking specifically at the section regarding Affidavit of Support. Now I could have sworn i saw something somewhere about not having to do this any more, or not having to do it for British citizens or something like that? Am I correct in this or have i misread something? (I cant find the original place i read it)

aha found where i read it, on the US consulate web site (london):

"Assemble all of the relevant documents required in support of your application and forward the document checklist, IV-15K, to the Immigrant Visa Unit. These documents must not be mailed to the Embassy. You will be required to furnish the original of all documents and one copy on the day of the formal visa interview and medical examination.

Evidence of Support: An applicant for a K visa is not required to file an affidavit of support, form I-864 at the time he or she applies for a fiancé(e) visa. However, the Immigration and Nationality Act does require the applicant to establish to the satisfaction of the consular officer at the time of the application for a visa, and also to the satisfaction of an officer of the U.S. Citizenship and Immigration at the time of application for admission to the United States, that he or she is not likely at any time to become a public charge."

However the form listed on this site is an I-134 not I-864.

Can anyone shed some light on this?

The I-864 is for the AOS after you arrive and are married. The I-134 is used for the consulate interview. In essence it is the same thing, same kind of evidence needed etc. The I-134 is not an enforceable contract, the I-864 is. It is true that you do not need to use the I-134. But your fiancee DOES have to satisfy the consulate she can support you. The I-134 is a convenient form to use for that purpose.

This is true at ANY consulate, nothing special for Brits. Sorry.

I've no idea how it's done in UK, but this 'letter of intent to marry' is turned in, signed, at the GUZ consulate on interview day - ie - it's not turned in with the original I-129F petition inside the 'filing packet'.

It's something that IS covered for the P3, for a K-1, is the UK consulate asking for this letter to be sent in? Did you receive a P3 packet???

Sorry, I can't determine which 'phase' your petition is in/at.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

THEORETICALLY the London consulate will allow a K-1 visa applicant (beneficiary) to self-support, i.e., provide evidence of assets sufficient to support him/herself upon arrival in the US.

IN REALITY, they will require evidence of the US citizen petitioner's resources to support the beneficiary after entry, and in practice this means they will ask for an I-134. A UK applicant recently posted that his visa issuance was delayed because he fell for the consulate's web page and neglected to obtain an I-134 and supporting documents from his US citizen fiancee. Smart move: learn from his mistake.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

The initial I-129F submission requires "original statements" affirming freedom and intent to marry from both the petitioner and the beneficiary. This is listed in the I-129F instructions (5.B, pages 2-3 of the instructions), and is a REQUIREMENT of the initial I-129F petition to USCIS.

Consulates often require a second, updated letter of intent from the US citizen petitioner at the time of the interview. While the content can be identical, this is a separate and distinct letter IN ADDITION TO the ones that are REQUIRED at the I-129F initial filing.
