File I-129-F while waiting for I-130

Can anyone help? I met Xiu Juan in 06, We got engaged in China in 07. Upon return to the US I started the K-1 fiance visa petition throught a peominent Immigration Lawyer. Her hearing was scheduled for June 30, but the embassy In GZ did not notify the lawyer until July 12. She was turned down and sent home crying because there was no case file. Upon hearing of this the lawyer sent the file Fed X the next day. No good, even thought the error was on their part they would not reconsider and sent the file back to the US for revocation. The lawyer (Andrew Dutton ) quit the case in frustration and I was left to start over. I began the process of obtaining permission to marry in China. I secured permission from Secaratary of state Hillary Clinton , the govenor of WV, the county executive and the Chinese embassy in Washington. I traveled to Haarbin china where my fiance and I boarded a train for the overnight trip to the place where we had more papers validated and returned to Harbin two days later to marrry at a government office. Upon my return to the US I filed the petition for the I-130 spouse visa. A week later I got a letter from USCIS that said our original K-1 visa case was finally reconsidered and approved. This meant she would have a hearing and leave China this December.. But, the embassy found about the marriage and stopped the K-1 case. I have been unable to find any further infomation or even if the I-130 case is still pending. The won't answer mail or e mail and forget the idea of a phone call. I would appreciate any help anyone can offer....thank you.......tom

Who is "they"? Did you receive an NOA2 for the I-130? The best way to find out whether or not it's pending would be to take that receipt number and check the USCIS website, or call them to ask. When did you file?

Hi tom25411,

Firstly I'm very sorry to hear your story. Cause you got married and petitioned for I-130, K1 will be dropped, as that's fiancée visa. I sucks that they wont take blame for their mistakes. Have you received a receipt number for the I-130 you petitioned? Once you have the receipt number you, as the petitioner can call to get a case update. I advise you to appoint a lawyer.

I of course meant NOA1. I'm sure you'd know if you'd been approved already.

You can find out case status with USCIS, you have an NOA-1 notice from a service center, yes?

There's a phone number to call, and a menu system to wade through, but you CAN get a human and ask about the I-130 status.

I'd not worry about the K-1, much, as GUZ has already stated they won't process it...

They can't process it, now, because you two are already married.

Let me know if you need the phone numbers for USCIS and DOS.

What date did you file the I-130 ? Did you receive an NOA-1 on the I-130 ?
