Timeline

I have been researching and researching and need some guidance from any vjers willing to listen. I am trying to understand the whole greencard/visa process.

1) What is the difference between CR-1 and K3?

2) From what I have been able to see from this website...it seems that several people have completed the CR-1 process within 6 months...is this the norm?

3) I currently have been living in the UK for 3 1/2 months but am a USC and my husband is a UKC...I want to move back to the states instead of staying here and doing the DCF route due to finding out that I am 3 months pregnant...does this have any impact on which process I should/can follow? If need be...I can get a co-sponsor.

4) Is the process more successful/faster utilizing a lawyer?

Any guidance/responses would be greatly appreciated!

CR-1 - Greencard on approval. This means that on entry into the US you can begin work immediately and do not have to pay anymore fees until Removal of Conditions is due

K3 - No Greencard. Once you have arrived in the US, AOS papers must be filed at a cost of $1010 and work can not be undertaken until work authorization is recieved. The K3 used to be a much faster route to getting your spouse to the US, however the gap in processing time is closing (about a month in it) and at present it is far more economically viable to undertake a CR-1 petition for the reasons listed above.

2) From what I have been able to see from this website...it seems that several people have completed the CR-1 process within 6 months...is this the norm?

The below link gives the overall average number of days from filing to interview. There is no norm although 6 months seems very optimistic given that K1's tend to take that long

For you to be eligible for DCF in London you must have been living there for a minimum of 6 months immediately prior to filing the petition and have leave to remain there. This means at present you are not eligible to do so.

4) Is the process more successful/faster utilizing a lawyer?

NO - unless you have a complicated case a lawyer is not going to expedite your petition. In fact a number of people on this site have employed Lawyers to their detriment - things hadn't been completed properly..etc.

AOS complete!

08/21/2009 - AOS package sent

08/28/2009 - NOA 1 for AOS, EAD, AP

08/31/2009 - Cheque cashed

09/05/2009 - Biometrics notice received

09/23/2009 - Biometrics Appointment

09/23/2009 - I-485 Transferred to CSC

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

Hola soy de Puerto Rico y mi esposa es de Colombia ambos comprendimos el proceso de visa, pero tenemos muchas dudas, ojala nos puedan dar una mano. Ayer (13 de septiembre 2009) recibi de Inmigracion la aprobacion de la I-130 y hoy (14 de septiembre recibi la aprobacion de la I-129F, pero no sabemos despues de ahi que se tiene que hacer si alguno de ustedes es tan amable y por favor nos explicara que se tiene que hacer ahora, que tenemos que esperar. Gracias anticipadas y muy bueno su forum.
